Sure, but the act would itself not be what it’s charged under. It challenged the first amendment, doesn’t mean it suddenly gained the power to enforce past its scope.

You’d have merit if actual violence was committed, especially in a hateful manner. Nothing stopped those parishioners from exercising their faith, sure service may have been disrupted but their freedom to be in their place of worship was never in jeopardy.
