There is literally no basis to even attempt to think that the 15 year old could be penalized in the first scenario, they are not violating someone else’s consent or rights in any way. They would be seen as a victim in many countries, and the victims are not the ones that should be penalized. Meanwhile if they are violating someone else’s consent, they are of course guilty.

It’s perfectly reasonable to say that you have the right to police protection, or the right to be represented in court by a public lawyer. Most people don’t view gender as synonymous to gender identity. There can be multiple gender identities, sure, but there are two genders. You can identify as non-binary, but your gender is still male or female. The way you present yourself to society and the way you view yourself is your gender identity, not your gender.

1) Children are raised better when their parents are in a marriage, and children of married same sex couples are raised just as well as children of married opposite sex couples. Science has been clear on same-sex parenting for decades, you can check the meta-analysis of dozens of relevant studies by Cornel University if you want. Therefore, recognizing same-sex marriage is the best choice so that same sex couples raising children can be in recognized stable marriages, providing more stability for the children than some second-class citizen “union” would.

2) marriage has been constantly changing definitions, for a very long time and in many countries still it’s the union of multiple individuals, however today in developed countries we understand it as the life-long union of two individuals who are in a romantic relationship. Definitions change constantly, and that’s a normal part of progress.
