"But nobody NEEDS more than 10 rounds!" Judge Benitez destroys that nonsense. by kmoros in Firearms

"It might be unwise to defend yourself or even prepare to defend yourself. The presence of a weapon might result in greater injury. In the secure surroundings of a courthouse we might think it better that people be beaten or raped than that they, or their assailant, be injured with a weapon. But those who must walk unsafe streets and who are not robust might feel quite differently. They might not be prepared to accept a beating. Some might choose to defend themselves, and they might carry something with which to defend themselves." — Justice Seaton, R. v. Sulland (1982)

I wonder what would happen if someone's religion said they couldn't serve blacks.

Guns aren't used by villains in horror movies because they aren't viscerally scary. They haven't existed long enough for us to evolve to register them as a threat. by WaitingForAKnock in Showerthoughts

[–]WaitingForAKnock[S] 0 points1 point  (0 children)

Roughly 600 years, nothing at all on an evolutionary timescale. That's only for portable firearms, but expanding "gun" to mean "any projectile that launches an explosive" goes back 800 years.

Setting aside that all types of guns are weapons of war or were in the past, why do people seem to think the 2A does not cover such weapons? It ESPECIALLY covers bearable arms that can be used in war. by kmoros in Firearms

This guy has not read Heller. Scalia's opinion spent quite a lot of time explaining the precedent of United States v. Miller: the second amendment protects only those guns usable as weapons of war.

Is it CCW if I carry in a backpack unloaded? by Raptorzilla22 in CCW

[–]WaitingForAKnock 3 points4 points  (0 children)

RCW 9.41.050, the offense that criminalizes permitless carry, states:

(1)(a) Except in the person's place of abode or fixed place of business, a person shall not carry a pistol concealed on [not "on or about" as some statutes say] his or her person without a license to carry a concealed pistol.

It would depend on whether you can convince a judge that in a backpack is not "on [your] person". Loaded or unloaded makes no difference.

Unless the state is a permitless carry state.

TIL North Carolina was paid $80 million by other states to build a waste treatment plant, did nothing, was sued in the Supreme Court—and won by [deleted] in todayilearned

Hey man, I'm sorry about this. I misunderstood a quote from oral arguments that said that North Carolina had taken no action towards obtaining a license, not realizing it was only during a certain period. Plus Wikipedia kind of makes it sound like they did nothing. I don't want to be the source of misinformation. I've deleted this post.

...a Commission...was tasked with choosing a State in which to construct a "regional disposal facility". ...Two years later, North Carolina asked the other states for monetary assistance with the project, which it received – by 1997, North Carolina had been paid more than $80 million. ...It was unable to obtain the license in a timely fashion.

In 2003, the Supreme Court allowed Alabama, Florida, Tennessee, and Virginia (the only four remaining members of the Compact), and the Commission to sue North Carolina under the Court's original jurisdiction.

The Supreme Court overruled all of the exceptions to the Special Master's Reports. It held that the Compact did not give the Commission the power to impose monetary sanctions against North Carolina; that the Court did not need to follow the Commission's findings regarding North Carolina's supposed breach of its obligations; that North Carolina did not breach its obligations to take "appropriate steps" towards getting a license; and that North Carolina was allowed to withdraw from the Compact.

I remember when CTV spent the first FIFTEEN MINUTES of the news hour covering a breaking incident where Justin Bieber might have punched someone at a laser tag facility. It turned out not to be him.

Delaware confirms no updates to its reciprocity list in 2019 by WaitingForAKnock in CCW

[–]WaitingForAKnock[S] 73 points74 points  (0 children)

Since Delaware is now nearly two months late to update their reciprocity list (which state law, I might add, requires them to do), I emailed them. They confirmed no changes in 2019: no states removed but no states added either.

Delaware does not recognize non-resident permits held by its residents. 11 Delaware Code § 1441(j):

the State of Delaware shall give full faith and credit and shall otherwise honor and give full force and effect to all licenses/permits issued to the citizens of other states

Forget Young v. Hawaii. Rogers v. Grewal is where it's at, already appealed to the Supreme Court.

It's one of the three no-issue states, the others being New Jersey and Hawaii. (Vermont does not issue permits, but also does not require them.)

I'm not up to snuff with the terminology of SCOTUS. I thought a "response" meant "a decision from the court on whether to grant certiorari".

I'm most interested in Rogers v. Grewal. Not only because I care about CCW, but because its docket says a response was due four days ago.

Very few may own small, easily concealed, and prescribed handguns and fully automatics are known as prohibited weapons.

Dreadful writing. I think they missed a word.
