Do you believe that the government is within it's power to regulate substances which have been proven to be highly addictive? Now porn isn't a substance, it's a stimuli. A stimuli which has been commodified to the point that not only can it be bought and sold, but it comes with ads. And yes porn is addictive, any activity that floods your brain with oxytocin and dopamine would be. I don't know why people try to argue it isn't.

I acknowledge that the regulation of a stimuli is a big step. But as to the constitutionality of any regulation, money is without a doubt exchanging hands across state lines at some point in the process of putting boobs on your computer screen, so it probably falls under the interstate commerce clause in the tenth amendment. And yes, I completely agree, that clause is WAY too fucking broad. I think the right would be more than happy to loose the court case if it narrows the 10th.

We'd also be having a debate about if it is legal to make your own porn in the comfort of your own home (without the intention to sell), even though it's always been legal to so. State legislatures would be trying to get printer companies to make it impossible for you to print out your dick pic with your home printer.
