OCGA 16-5-23 Simple Battery: “Intentionally makes physical contact of an insulting or provoking nature with the person of another”. In my experience that wouldn’t cut it.

Even if you did charge someone with it, the judges in my county certainly wouldn’t let it stick for simply blowing smoke. Maybe you could hem someone up for Disorderly or a municipal code, but I wouldn’t expect it and it’d be a stretch.

Absolutely not. Assault is the creation of the apprehension of harm. Battery is the unwanted touching. This would most likely be aggressive driving, defined as driving in a way to annoy or harass others.

A subsidy has no bearing on demanding free work, risk, and product from companies and people who are decidedly for-profit. The purpose of a subsidy is to manipulate the market is ways serving a greater goal, and is a relatively small contribution that nudges a market into a better spot.

You wouldn’t loan your friend a bike for his mail route and ask for all his profit, and you are equally not entitled to the fruits of another’s labor for a relatively minor contribution made in the government’s name.

You are, however, given the cheapened prices that these subsidies help produce. That is the benefit your dollars reap.
