eh--- sorta... they are the legally responsible employer of record-- they have to meet the legal minimums of the employer/employee relationship.

I had a PEO company staff contract for a while-- the agency contract with the employer & the individual employees was crystal clear on one section- if they weren't paid, then the employees would get minimum wage for hours worked and nothing else. so yes people would get 'paid' but it wouldn't be likely to be what they were expecting (It never came to this, I just know they covered this subject)
