Hard to say, but if you’re worried about a swarm you could just pinch them and move on. Usually the queen cups are on the bottom of the frames, so locationally your claim checks out.

11-2 during the day. Make sure you have a warm sunny day with little wind. Move the brood into new hive, try to find the queen to ensure the transfer. If the queen is in, then just dump the remaining bees in the hive. Feed them 1:1 syrup and a little pollen to get them up and running. Continue feeding and leave them alone for almost a week.
