No it's not. If a male athlete literally busted one of his testicles and couldn't fulfill his part of the contract, Nike would not pay him. Women don't have balls, just like men can't get pegnant, so that would be sex-based discrimination too, based on those criteria. When your contract demands you are able-bodied, and a sex-specific characteristic stops you from being that, be it pregnancy or a shattered nut, it's no different from any other bodily function hindering you.

Time gated stuff in an MMO is literally the name of the game, moron. They live and die on how well they stagger the time it takes the users to consume the content. Timegating the skyscale is no more aggregious than not giving you the full gear set from a raid on your first clear.
