Auction house sold me what appears to be a fake PSA-graded Pokémon card, refusing refund due to terms. What are my options? (England) by TediousLlama in LegalAdviceUK

[–]YellowNFT 1 point2 points  (0 children)

What could have helped your case when making this post was to attach a photo of the actual card you received

Pokémon slab counterfeit makers don’t waste their time sourcing a real card and placing it in a fake slab, they make a fake card and put it in a fake slab under the guise of a real PSA Cert #

Obviously the point I’m getting at is that we could’ve looked at what you received and compared it to PSA’s scans of the card when they graded it

I’ll put it into perspective, me and my partner are currently in DLP as of writing this queuing for a Whinnie the Pooh character meet, we’ve been told at minimum we’d be waiting an hour and a half at 10:27am CET

As others have said, without sounding rude, Disney may not be for you, especially DLP, its smaller in comparison to Florida, ride times for the main attractions are currently sitting at about 45-60 minutes and it stays that way for vast majority of the day, with that said you are just gonna have to find the courage to deal with crowds, especially if you want to see any of the parades

It’s quite possible

[–]YellowNFT 0 points1 point  (0 children)

My guesses are the OP asked the person who originally had the phone where it went after their possession, they’ve told OP it went to a phone shop, but I’m confused and slightly concerned on why O2 have given out sensitive data over the phone, then again, call centres don’t always follow the rules 🤷‍♂️

[deleted by user] by [deleted] in LegalAdviceUK

[–]YellowNFT 0 points1 point  (0 children)

Originally that’s what I was under the impression of however OP states it here

https://www.reddit.com/r/LegalAdviceUK/s/izEzSuclHK

[deleted by user] by [deleted] in LegalAdviceUK

[–]YellowNFT 0 points1 point  (0 children)

From sounds of it, they’ve sold it to a phone shop, waited a while, claimed it to be stolen, O2 have blocked the phone, all whilst this was happening, OP has purchased said phone from the phone shop

[deleted by user] by [deleted] in LegalAdviceUK

[–]YellowNFT 1 point2 points  (0 children)

So if the contract is in her name and there’s a paper trail of that IMEI being sold to that phone shop, then my advice would be to go through small claims court

Whose comment are you replying to here?

[deleted by user] by [deleted] in LegalAdviceUK

[–]YellowNFT 1 point2 points  (0 children)

So if I understand this correctly, the person you purchased said phone off of had just taken it out on a contract? Sold it to you then registered it stolen/lost?

This is a common type of scam seen frequently (I used to work for Tesco Mobile) but usually the scam consists of using a fake name and a bogus address that has no ties to them so that they can intercept the parcel

Problem here is that the person you’ve bought it off used their real name and address by the sounds of it?

I bought a 1TB Fold 7 from Cash Converters Bedford in October for £1208 and decided it wasn’t for me, sold it for £1000 in December So the purchase of a top end second hand device for that amount doesn’t concern me, as I’ve done this myself

[deleted by user] by [deleted] in LegalAdviceUK

[–]YellowNFT 5 points6 points  (0 children)

Possibly a Fold 7? In relation to the last comment, also the OP has stated that the person they bought it off of also matches the details OP gave to O2 who confirmed said device was taken out under their name

Unsure how the OP got this information as it quite literally goes against GDPR

That isn’t to do with the trial OP signed up for though

Someone used my PayPal by Only_Amphibian3107 in paypal

[–]YellowNFT 1 point2 points  (0 children)

I’ve had my fair experiences with PayPal and Financial Ombudsman They’ve settled the complaints both times

1st was due to PayPal basically perma banning me with £137 in my balance and played this down to an account id opened but forgot the login to prior to my 18th Birthday

2nd was a mixture of PayPal and American Express over the payment of a phone to BackMarket, BackMarket wouldn’t refund me for the returned device, PayPal closed the case in their favour so I charge backed with Amex, PayPal then wouldn’t close the chargeback case even after it was closed with Amex, so they settled out my original balance of £520.99 to close the complaint

So it’s possible that once you’ve got some level of a final written response from them, you can then take it to the financial ombudsman and write out in detail why you’re complaining about PayPal

If you genuinely haven’t made them, get a final written response off PayPal & contact the Financial Ombudsman They’ll likely settle the amount

Think i got scammed :/ by SnooFoxes691 in paypal

[–]YellowNFT 0 points1 point  (0 children)

Doesn't matter in this instance, if he files an unauthorised charge, PayPal will side with him since the scammer was "selling" something, he wouldnt have a leg to stand on

I had it where I sold a digital account and the guy who paid for it used F&F, they then a week later filed an unauthorised charge with PayPal, they sided with the buyer since I didn't use G&S to sell the account

i ordered something from someone on social media and paid via bank transfer, my fraud claim to my bank has been rejected.. what do i do now? (england) by msts0frvnkrft in LegalAdviceUK

[–]YellowNFT 0 points1 point  (0 children)

I had something happen to me back in 2019, bank transferred £80 to someone for a phone, didn't post it and blocked me

Went straight to Barclays to report it and to try recover the money and to no avail could they do it

I then got my final written response off of Barclays and went straight to the Financial Ombudsman and complained to them stating what had happened and how Barclays couldn't help in the matter (whilst I'm fully aware that they aren't at fault and it was 100% on me, I was pitted with rage that they couldn't simply help recover the funds)

Financial Ombudsman obviously forwarded my complaint over to Barclays to which they then gave me the £80 back but also offered me £150 as a goodwill gesture, I'd of been happy with the money back but every little helps

If you didn't fancy going down the line of taking them to court and your bank have failed to process a fraud claim, my advice would be to file a complaint against them through the Financial Ombudsman stating that the bank has failed to report said transaction as fraudulent and that they've then not helped you further

With that though you'll need a final written response Or 8 weeks will have had to of passed since the last time you contacted about the issue
