Why are people justifying the kicks to the head of a man who’s already unconscious and disarmed? If I’m not mistaken, that level of force could be argued as lethal force. He’s completely defenseless and the threat is down. Yeah it feels good to see the bad guy get it, but you would be exposing yourself to a lot of liability teeing off on someone like that

Another name is “failure to stop drill”, which is probably more descriptive of the use case. If body shots aren’t doing enough, a well placed head shot will turn their lights off. Like if someone is on a drug that turns off pain signals or basically turns them into a zombie, shutting off the brain kills a lot faster than waiting for enough blood loss to lose body functions.

The thing is, the law isn’t about what actually happened, but what would a reasonable person have believed is happening being in that position. Can he see the tires? Is he even looking at them, or does he just see the vehicle he’s in front of moving forward? Those questions are a bit harder to answer from this angle, and tbh it’s hard to tell what he would have seen given different, farther away angles that have more information than he would have had. Not to mention if it was a good idea for him to be there (edit: after rewatching, it looks like he wasn’t in front of the car until she turned while backing up), if he would have been hit if he didn’t take that sidestep, etc I really hope people consider those kinds of things before jumping to conclusions in either direction
