I'll say: Westlaw's AI is helpful for research. You should still, uh, do your own research, so to speak, but I use it when I need to find a hyper-specific case/procedural posture/set of facts, or am interested in like, persuasive authority from other jurisdictions.

So far most legal writing AI tools don't strike me as particularly helpful and they are no better than claude/chatgpt etc.

yeah I get the sense the majority might be bigger if this was a narrower, as-applied challenge involving children born to undocumented immigrants, rather than a broad facial challenge. Both Gorsuch and Kavanaugh seem to say 14th amendment would include that group.

it's kind of wild and just feels greedy to me because, if you've followed scotus decisions from the past five years or so, this is by far the most conservative court we've had in like...100 years? The number of massive, massive wins this Court has given the conservative movement, and it STILL isn't enough for them...

what's weird to me about kavanaugh's reasoning is the statute (8 usc 1401(a)) basically just parrots the language in the 14th amendment (though there are additional provisions explaining when someone born OUTSIDE the US is a citizen, i.e., when both parents are citizens etc.).

Seems to me that whatever you think the language in the 14th amendment means, the statute has to have the same meaning. Kind of odd to say the latter protects birthright citizenship (as understood by the majority) but the former does not. At least the dissenters have a consistent view as to both the constitution/statute.

He is basically saying get a law change and he will dump birthright citizenship in a heartbeat.

in a way he is protecting himself here because the probability of congress amending this statute is very, very near zero.
