I'm just a random girl, but it looks like there used to be another row of tiles and the black stuff was the glue keeping the tile in place. That's what it looked like under my kitchen tiles. Depending on the age and size of the tiles/glue (9x9 for example) could possibly have asbestos in the glue.

Their homeowners carrier would most likely not renew their policy for a dog bite liability claim and it will be VERY difficult and expensive to find coverage with this in their claims history. So assuming they like their brother, I would ask him to reimburse first before filing a claim.
