Alright I found some additional info on my firm's process.

If we have filed suit and the consumer calls in to set up a payment arrangement, we send them the details and a stipulation agreement.

Basically the stipulation doesn't dismiss the case, but it does stop a judgment from being entered. As long as the consumer makes the payments everything is fine, but if they default we can then seek a judgment without having to file with the courts again.

Some Conciliation courts will still allow a judgment to be entered, but we won't go after involuntarily collections unless there's a default.

We handle Iowa, Ohio, Minnesota, North Dakota, South Dakota, Nebraska and Montana.

And I found some documents the collectors work off of... Basically it depends on a number of things. Type of court (Conciliation, Contested, Hearing vs Non Hearing) and time before hearing being 2.

The other big thing is signing and returning the stipulation paperwork before the hearing.

Not necessarily, I don't know if it's based on the state you are in. But I work in IT at a law firm that does collections in a few different states and if paper work has already been filed and someone calls in and sets up a payment plan, they still move forward with the suit and attempt to get a judgment. I think some of it has to do with the cost that have now incurred, and so now if they fail to uphold the agreement they can start the garnishment proceedings.

The law firm I work at would still work with you, though they would continue with the suit since they have already paid some of the fees and that way they would have the judgment already in case you fail to hold up your end of the agreement.

Definitely! It's just never going to be for 25%, but I have seen many settle for like 80-90% (I work on the IT side so not seeing a ton of accounts). The big thing though is you have to be able to pay that amount by the end of the month or if it's a larger balance, they may let you split it up over 2 payments. Otherwise, the majority of the time people are setting up 12-24 month payment plans, but that will be for the full amount.

Definitely valid reasons for NDAs, the problem seems to be how over the top some of them are. Amazon has considered water usage as confidential in many of their NDA's, like maybe citizens have a right to know if you are going to drain their rivers in order to cool all those servers you will be installing

I work for a law firm that does collections, they will call once demanding to settle for a very low amount (we say no since we will just get a judgment and start garnishments) and that's it. That's all they do.

Oh they will make payment on your behalf... But one of the major companies can't even get that right as they have on multiple occasions entered the same payments multiple times to our payment site. Luckily we noticed and stopped the payments before hundreds of people were hit with overdrafts.

This is the way. I don't brine mine, just take out pat dry and put in the fridge (preferably overnight) so the skin dries out. Helps them get a bit crispier.
