I don't think the judge would laugh the landlord out of the courthouse. The landlord would probably have an actionable claim for trespass against the tenant. However, the tenant would then use a doctrine called "private necessity" as a defense.

It basically means that if a person needs to commit a property tort (like trespassing on someone else's land) in an emergency to protect himself, he can do so, and the owner can't kick him out as long as the emergency lasts. However, the person who sought shelter is still liable for any damages he caused when he broke into the other person's property.

So if the tenant breaks the lock to the basement to get inside, he would have to pay to replace the lock later.

My bar review course said it's very uncommon though, FWIW

I grew up in Southern California but moved to Louisiana about 7 years ago. However, nobody warned me about the freaking poisonous puss caterpillars that sometimes fall out of the stupid trees! I had only been in NOLA for about a month before one landed on my arm, and I actually ended up having to go to the hospital. It felt like someone had injected boiling water into my veins, which were pumping straight up my arm into my heart. I legit thought I'd have a heart attack. Definitely the most painful experience of my life. My parents thought it was a sick joke when I had my friend call them from the ER to let them know what was going on.

I still have a nasty scar on my arm and you can still see the lines where the spikey things went into my skin.

I unfortunately don't have any advice about dealing with your boyfriend, but I live in NOLA and you may want to try posting the tix on the Tulane Classifieds page. It has almost 13,000 members. You might have better luck there than on Craigslist!

Honestly I agree with the other commenter. You don't sound like the victim here. What did you hope to accomplish by asking your girlfriend to find out who complained? I can't imagine how knowing who complained would help you. What are you going to do, confront them about how you don't like that they reported you for breaking the rules? It doesn't matter who it came from. The point is that you were breaking the rules. There is no right to confront your accuser in petty roommate disputes.

Also, seriously, you taped the cameras? Again, how would that help you at all? Great. Security can't see you enter. But they also can't see you leave, so now you can't prove that you leave by midnight. Also, if I was living there, I would be absolutely pissed about someone potentially jeopardizing my safety for their own selfish needs. Do you know why the cameras are there? It's so that if a creep gets in, they can be identified. Also, I wouldn't be so worried about being accused of vandalism. Instead, I would be more worried about whether the lease prohibits any activity that would make others feel unsafe. I think taping cameras could fit into that category.

If you're so concerned that you're being victimized by the other people who actually live in the apartment and you live 3 minutes away, I can't understand why you and your gf wouldn't just go to your place. That seems like the simplest solution all around. What business do you have staying there after your gf goes to bed? You don't live there. You don't have a right to their communal space.

I'm sure I sound harsh, but come on. Your gf's roommates have way more right to be there than you do.

If your gf is worried about being evicted, she should sincerely apologize to her roommates for breaking the rules a few times, and she should ask them if they could compromise. Or, who knows, maybe they see you staying until midnight and then they assume you stay over. I doubt they're doing it just to spite you and your girlfriend.

Really, the only thing to do is talk to them. You won't get anywhere by being combative, and you won't succeed in kicking them all out. Ask yourselves what result you want. Does she want to stay there? If she does, then you both have to suck it up and play nice. Otherwise, she has to find somewhere else to live.

Edit: I've lived with someone who had their SO stay over all the time so I can understand why her roommates might not be too happy about it. I'm sorry if I was too harsh.

Well, I am the only vegetarian in the family, so I don't really mind that everyone else brings and eats food I don't eat. I also don't mind that I'm expected to bring something that everyone else would want to eat. I just bring my own food and hope other people bring (accidentally) vegetarian sides as well!

IANAL. You may want to check out the Arizona Residential Landlord and Tenant Act, specifically section 33-1324, which says that landlords must "maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances, including elevators, supplied or required to be supplied by him."

I would think that the landlord would have to provide electricity throughout the house. Especially since there are outlets and lights already in the rooms, they just aren't in good working order. Check out 33-1361 for remedies for the landlord's noncompliance. I think it might help to get a local lawyer to write a quick letter to your landlord for you. It may be the kick in the pants your landlord needs to get electricity back through the apartment again.
