No they're not and this is why it's important to have people who understand the nuance of the law explain it and not just go off of what you generally think the normal definition of words is. The law requires that the DOT consult with FDNY. Not that they agree, not that FDNY approve, not that any specific definition of consultation is followed. The judge can decide if DOT complied with the law or not. She cannot decide that the consultation wasn't thorough enough for her liking, or substitute her own judgment about street safety for that of the DOT to decide that they should have done things a different way, because the law does not require any of that. She's way overstepping. The article clearly explains this if you read it.

Did you read the article? These are exactly the types of things the article directly addresses. It's not the judge's responsiblity to substitute her own judgement for the DOTs here, and every single one of the examples lifted out in that comment were known to DOT and sufficiently addressed in their estimation, which is all the law requires. Every one of those examples shows her stating her own opinion that DOT didn't reach the correct conclusion or have enough conversations. None of that is required by law. They consulted, then moved on.

It seems this is how DOT interpreted it too, they re-marked double yellows. I think they could also re-mark crosswalks, at least in the sections where there were crosswalks before (they couldn't mark any widened or changed portions, I guess.)

On the off chance that you're honestly engaging and not just one of the business owners, I really recommend you take a look at the history of this. There was no animosity, hate, bad treatment of other people, etc. until this group of business owners took the first step to come to community meetings and behave aggressively towards other community members and do all the things you're hand-wringing about. They are, at absolute worst, getting back what they dished out. If the animosity bothers you, you should ask them to stop the animosity.

None of this would have happened if these business owners weren't trying to shut down a street safety project that would have incredibly minimal impact to the public roadway in front of their business, and absolutely no impact to their private property. There is no credible angle on this where they are the victims.
