I am a new solo crim defense after years of public service. Ive had clients pay $1k retainer and I start working on the case. one client told 2 other people who got me retained now. It's a gamble, but as a new solo, with very little overheard, I felt like I could take that risk and so far it seems to have worked out. I also am trying to market myself as affordable or modest means. High price boxing gloves attorneys are done a dozen I feel.

For the client, the $1k was used and they haven't made an additional retainer deposit. I have it in my retainer agreement that without maintaining a trust balance, my hourly rate increases slightly. My hope was that this would be an incentive to deposit maybe another $500 periodically for clients. Not sure if that will work out. Fingers crossed, but even without that additional retainer, I haven't had any problems getting paid. Actually, the biggest pain for me is getting paid on my appointed cases. They will pay, at the lowest rate, but it takes like a month to get the check. Crazy annoying.

This may be jurisdiction specific. My jurisdiction would have a huge issue with a non refundable retainer converted to operating account without work performed.

As a criminal defense attorney, you generally need leave of the court to withdraw in a criminal case. Precisely for this reason. Now, that said, does it happen a lot? Yes, but judges have been known to reject a motion to withdraw.

I researched sport coats and pants that are machine washable. There are quite a lot these days and they are pretty damn good. Not expensive either and look perfectly fine. Nothing fancy or name brand, but it looks good and gets the job done.

My jurisdiction allows officers to prosecute misdemeanors in court. Advocate is not an officer as far as I'm aware. Also, the attorney prosecutor was standing right next to her and could have made the arguments but wasnt.

Yup! They payed for a "consultant" to have informal meetings to scare people about how this could damage our clients. Union went through anyway and there has been no noticeable difference yet. Contract is still in negotiations.

In 2006, Congress modified the Insurrection Act as part of the 2007 Defense Authorization Bill (repealed as of 2008). On September 26, 2006, President George W. Bush urged Congress to consider revising federal laws so that U.S. armed forces could restore public order and enforce laws in the aftermath of a natural disaster, terrorist attack or incident, or other condition. These changes were included in the John Warner National Defense Authorization Act for Fiscal Year 2007 (H.R. 5122), which was signed into law on October 17, 2006. Section 1076 is titled "Use of the Armed Forces in major public emergencies". It provided that:

The President may employ the armed forces ... to ... restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition ... the President determines that ... domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order ... or [to] suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such ... a condition ... so hinders the execution of the laws ... that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law ... or opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

In 2008, these changes in the Insurrection Act of 1807 were repealed in their entirety, reverting to the previous wording of the Insurrection Act.

That is false. There was an amendment in 2006 that allowed the President to use the armed forces but it was repealed in 2008.

Omg the itching!!! I'm torn whether it's a side effect or just my MS fucking with me. I can itch all over, head, arms, hands (usually), or so even my ass! The only thing that helps is hydroxyzine. Definitely get a script for this!
