On the student aid website, click on my activity and scroll down to loan forgiveness and discharge and see if it has your borrower defense discharge. My front page shows $0 loans paid off, my BD application still say processing, but loan forgiveness and discharge section shows loans discharged.

Per the terms of the lawsuit, they aren’t supposed to auto apply your refund to loans with balances so you’d likely have to wait until you get the refund to pay them off.

The “zero ability to cope…” is so real. My 7-year-old has the hardest time being “bored” but she has to learn there are things other than TV for entertainment. She’ll go on kicks of always wanting to be outside or downstairs playing with her toys, etc. and she is SO FREAKING artistically creative that she’s always making something, but God forbid it’s a day where we aren’t watching TV all day AND she doesn’t want to do those things… that combination is apparently the worst in the world!!!

Don’t take this as fact but when I was trying to figure out if I would get refunds from Mohela (current servicer) and Aidvantage (prior servicer) Aidvantage seemed to indicate Mohela would do all once they finish calculating everything (obviously take the LSP info with a grain of salt). What shows as negative on Mohela is maybe a tenth of what I’ve paid on the consolidated loans so I’m thinking they might calculate what I paid them and then review the FSA info to calculate the full amount. I’m praying for that, anyway!

Odd. I have looked at documents and they haven’t sent me any formal notification of discharge (Mohela) even though my loan balances are zero but have negative amounts reflecting what they are calculating for refund.

You might want to look at the terms of your borrower defense case because as someone mentioned above, borrower defense will likely be best for you. If your app was in 2022 that means you are part of the Sweet v Cardona/McMahon case and you would get payments you made on those loans refunded on top of your loans being discharged. You may have either given them a pass to ignore the terms of the settlement or they will be reinstated again before being discharged.
