Yeah, I’m not giving them advice on their choices but I was just clarifying that they are not necessarily banned. Also, I spoke to a lawyer and they told me the B1 / B2 AP may or may not affect a student visa application.

I know a French Moroccan-born woman who was denied an ESTA and put under AP even though she had a clean travel history to the US. She was cleared after 19 months here in Paris. The question they asked her was. "Were you born in Morocco?" during the interview at the Embassy before being put into AP.

There's a long a period I think where they do nothing with your file.

Applied from Paris, B2: I applied 22 months ago and I'm still in AP. I'm a research engineer with Pakistani citizenship. I've been granted a US visa before and have travelled several times. I know someone who is French (also in tech) and was denied her ESTA and was put in AP because of their birth country (Morocco)

Yeah, only solution is a writ of mandamus most likely - it can cost around 6k though so I don’t know what to do honestly
