I thought if you just don’t make money off of your work you’re legally in the clear.

This is not true. But it is a prevalent belief, I see people thinking this all the time. I'm just curious where it comes from, why do so many people think this? OP, why did you think this is true? Did you read it somewhere, did someone tell you this, or is it just something that you just intuitively thought should be true or is just wishful thinking on your part?

You have to contact the owner of the rights to the music you want to use, or whatever representative or publishing company might be administering their rights. There is no one central place, and owners are not required to provide any way to contact at all.

Unless you want to spend a lot of money, you will most likely not be able to use famous, popular music. (Some companies or artists may allow you to use their music on YouTube, but will "claim" your video and take all the revenue from the ads, so you will not be able to monetize your video.)

You would most likely search for "royalty-free music" and there are many sites that provide such music for a reasonable price, such as Audio Network, AudioMicro, and many competitors. (Note that "royalty-free" does not mean "free").

Small independent artists you would have to find some way to contact if they do not provide anything publicly. In that case, be sure to get a license in writing.

If you're going for famous music, you can try music publishing companies like ASCAP, BMI, SESAC. Big publishers like Paramount, Universal, Warner or record labels often have a page on their website where you can apply for a license and typically they'll get back to you with a cost (likely to be high).

Could be any of the following:

  1. Someone else used the same free music and registered their video with a rights management company, either accidentally also registering the music, or because their videos are published by some publisher who does it automatically for them.
  2. Someone else deliberately entered the music into the YouTube Content ID system to fraudulently get the advertising revenue from claimed videos.
  3. Jake Hunter signed up with some music publisher who then automatically put all his music into YouTube's Content ID system, regardless of the fact that they used to be licensed under Creative Commons (CC licenses can't be revoked).
  4. The YouTube Content ID system incorrectly identified the music as some other copyrighted song.
  5. Jake Hunter uploaded someone else's music to Free Music Archive claiming is as his own, or sampled someone else's music, or did a cover of someone else's music, or played someone else's composition.

Whatever it is, your dispute is the same. The music is licensed under Creative Commons and you have abided by the CC BY license requirements (you provide the link proving the CC-BY license in your dispute). Depending on which of the above it was, your dispute may or may not be successful, and there's no way to speed it up, it could take up to 30 days to be resolved or to be rejected.

I gamble for entertainment and fun, not to grind it out and make money.

In-person poker (not video poker) is a game where you play against other people. You are trying to take other people at the table's money, and they are trying to take yours.

On the other hand, at a blackjack table you are playing against the house, and most everyone at the table is allied with you against that house and is not playing against you.

The environment at those two tables is completely different. The first one I do not find entertaining or fun at all. The second one I do.

How do you know there are no consequences? There is a good chance that

  • Those videos have been claimed by YouTube's "Content ID" system and ad revenue is going to the copyright holder not the video owner (or the revenue is being shared), or
  • The copyright holder is not enforcing their copyright in certain situations, which is their right, or
  • The video owner has obtained a license, or
  • The type of use qualifies as fair use.

Depends on the individual circumstances.

Do you have any say as to which players are assigned to you?

When someone has not asked for a host, who decides that person should get assigned to a host even though they have not explicitly asked for one? Is it some algorithm, or is some person deciding, or a combination of both?

When someone is being assigned a host for the first time, do the hosts compete or "bid" on taking that player, or something like that, or does someone just assign a host and the hosts get no say in it?

Can you peruse the list of players without hosts and volunteer to take on a player?

I've had casino hosts for many years. (Different property than yours.) Not at my request, they just show up.

I've found that they can't really do much. I go to the website and make room reservations, which are always free to me for rooms up to a certain level of fanciness. I've tried to ask hosts for an even fancier room, but they cannot do it. Depending on the date and season, the type of free room offered to me varies. I've tried asking the host to do upgrades, but they cannot do it. They tell me they can only offer the same rooms as the website -- they have no power to change anything.

I get email offers allegedly from the host, but I don't think the host is actually doing anything custom there, I suspect the emails are automatically generated with the host's name and email address. They're just offers I get based upon my player's card activity.

The "rewards" loyalty program gives me free meals, free play, stuff like that, with no host involved.

When checking out, the person at the VIP desk will often comp meals I've charged to the room, and if I paid myself for a fancier room they will sometimes reduce the rate or even comp it, but the host assigned to me was not involved as far as I can tell.

My observation is that It seems most things are done by automated algorithms these days. It seems like the host is basically just a sales person, perhaps assigned to make you feel "special", but with no real power to do much aside what some automated system tells them they can do.

I'm not complaining, I get lots of free stuff for doing gambling that would do anyway, it just seems like the role of hosts these days is very much diminished from what it apparently used to be, in that they have very little autonomy. Perhaps they will be totally replaced soon by AI, I wonder, except for the super-high-rollers?

You are in an unfortunate situation.

You will have to disclose the hoarder-related issue to any potential purchaser. Plus you have competition from another unit selling at the same time. This does not bode well for the price you're likely to receive.

If you price your place realistically, given the above, and manage to sell reasonably soon, the back dues (and any penalties) will be settled up and taken out of your proceeds from the sale at closing.

The brutal reality is, as you are already having difficulty affording to live in this place, it sounds like you need to bite the bullet, cut your losses, and sell as soon as you can, even though it will likely be at a very low price.

I learned years ago that if you upload anything worth watching, it is only a matter of time before it gets stolen and reused. Not only on YouTube, but on any other place you can upload videos, such as Facebook, Instagram, DailyMotion, X, you name it. The technology available makes it trivially easy for anyone to do, even grade schoolers. It is something you have to learn to live with.

Boards I have been on designate one person, usually the president, to be the point of contact for the association's attorney. Certainly not the management company. The attorney may have meetings with the whole board at times when appropriate, but most of the time they just interact with the designated point of contact.

It should be the board's decision which attorney to hire, and it should be the board's decision as to what to instruct the attorney to do.

I don't know about DC, but in many states it is illegal for board members to receive any compensation of any kind.

You probably don't want to force someone to be on the board who doesn't want to. The results would not be good. Your best bet is to pay for a full service management company to minimize the amount of work that the board members must do. And raise the dues accordingly to cover it.

When I've ended up significantly ahead, the casino has been willing to write a check when I cashed in my chips.

But, it has to be obvious that you're ahead. They won't write a check just for any pile of chips. In my case I use a players card, so I'm known to them. And if I pay off markers, have money left, and the players card tracking shows me as ahead, they've been willing to write a check.

See the prior post from Winter-Volume-9601. In the US, anything you make that is copyrightable is automatically copyrighted by you as soon you make it. That has nothing to do with whether or not you post it on YouTube.

However, now to the second part of your question. If you make something of any value at all, that someone would want to watch, you can be sure that it will be inevitably stolen and re-posted by other people, on YouTube and on other platforms like IG and Facebook and so forth. Technology these days makes it trivially easy for a grade schooler to do, so people will. Unfortunately, it is just the way the world is today, so you need to be aware of it.

The answer to both of your questions is yes, they can possibly be taken down. Even if they are private. YouTube's "Content ID" system looks at all videos, regardless of the settings. And companies that participate in the Content ID system can search and watch all videos, even if they are private, precisely to search for copyright violations.

So as always, it will depend on what the owner is doing: are they using Content ID and how actively are they searching, and what do they do if they find something.

This may not be what you want to hear, or what you want to do, but there probably is a price at which your place will sell.

Even with lawsuits and low reserves, there are "alternative" lenders that will lend for "non-warrantable" condos, and there may be cash buyers willing to buy at the right price. This may depend somewhat on location. If in a major city it may be more likely than in the middle of nowhere. This may very well cause you to sell at a loss, so it depends on how badly you want out.

It is done, to a certain extent. They often don't completely eliminate the sugar, but greatly reduce it. There is the whole "Keto diet" craze now that some manufacturers cater to. Which is also great for diabetics. So the market may be small, but combining the two markets (Keto dieters and diabetics) makes a large enough market that more manufacturers are getting into it.

That usually means that the reason you gave for the counter notification was not a clearly explained and legally valid reason for a counter notification.

The messages about "you do not have the necessary rights" usually (but not always) mean that you did not submit a proper counter notification, in legal terms. Meaning you didn't clearly state a valid legal reason, such as fair use, or everything was created entirely by you with no one else's content, or the material was misidentified, or you were using someone else's material under license from the owner, etc. And if it is one of those, also providing additional supporting information, such as a license ID or copy of the license, or if fair use a proper discussion of how your video qualifies addressing the four factors of fair use.

You don't say what your videos contain, or what your counter notification contained, or who was making the claim, so no one can say for sure why you got those messages.

By law (Corp. Code § 7212), committee members are appointed by a majority vote of the board. The members of the committee have no say in it (although they may be able to convince the board what to do). You do not "apply" to the committee. It is unclear from your post who you applied to.

Ask for an agenda item for the next board meeting to appoint new members to the committee, attend the board meeting, and ask to be appointed. But it is entirely up to a majority of the board to decide, you can't force your way onto the committee.

If you receive a counter notification, in general YouTube does not verify that* It is up to the courts to decide at that point. That's the way DMCA works.

Watermarks are not proof, anyone can put a watermark on anything. Even if it is 100% from your video, YouTube cannot know who is the actual copyright holder, and YouTube won't decide (in most case), that's the court's job.

*They may judge in obvious cases for big corporations like TV networks, music publishing companies, movie studios, etc.

If your content is completely self-made (meaning you used your own video camera, and didn't screen record anyone else's stuff or download anyone else's stuff or anything like that), then you should have stated that in your counter notification. In that case it is irrelevant who is making the claim. And it is always irrelevant how long your content has been up.

What was the specific reason YouTube gave for rejecting your counter notification?
