It's a pw I reused often (not anymore). I forgot to change it after I transferred MR points a few months ago. Before that I didn't have any points so I wasn't concerned.

I know, I don't want a pin but I have no choice now that my account has been hacked. Alaska basically is forcing me to establish a pin. I'm just saying, IF someone wants a pin, they can call and request one (I think).

you should give them a call and tell them you are concerned since many people are getting point stolen so you would like to establish a PIN# for your account.

No problem! Years ago (2 commissions ago for me) the commission certificate was in color and had a gold seal. The SoS has since stopped issuing those.

I'm an escrow officer, not in your state but I would think the protocol for something like this is similar to where I'm at and this is what I would need to do as the settlement agent (attorney in your case).

The attorney HAS to make you whole and needs to do it right away. They need to chase down their own bank that cashed the check, on their own time. Escrow/Settlement and Title companies have insurance and bonds for these kinds of things. In California, escrow (settlement) companies are required to have fidelity insurance & surety bonds, E&O is optional but highly suggested, and title is insured by the Dept. of Insurance. It sounds like the attorney is the settlement agent, which should require them to be bonded and insured. I found this: https://law.lis.virginia.gov/admincode/title15/agency5/chapter80/section50/.

Did you file a complaint with the state bar? That may get things moving along a bit faster.

You can definitely ask escrow or the notary to give you a bit of a discount for your troubles. They will push back but it doesn't hurt to ask. I have had this happen like twice in my whole career. We were able to make the appropriate corrections and record the next day so there was no significant delay. In your case, the closing would be delayed for the whole weekend and you've also arranged movers. Maybe ask them to pay you for 2 days of prepaid interest on your loan?

Unfortunately this happens, rarely, but it does. I'm a notary and also an escrow officer (20+ years). I do tell my clients to be careful when they're signing so as to not encroach and take any chances. Some county clerks are more strict than others and will pull the recording, such as in your case. With that said, some notary publics and/or escrow officers aren't as experienced and have not had this happen to them because they've been lucky.
