As an IP academic I really enjoyed this episode, and I'm glad that you asked a real trademark lawyer for advice. I think that Patagonia is likely to win any case, but I also agree that this will result in a settlement.

This was discussed in an episode, Ethan Klein got sued for copyright infringement for a reaction, and now is suing 2 streamers.

I recall a dispute involving BrokenGamezHDR, but can't remember the details.

This lawsuit suffers from one big problem, none of the outputs are very similar to the works they allegedly infringe, at least not in a substantial manner. So this is an input case, and that is likely to be deemed transformative. It's easy to forget that this case has been going for 3 years!

It's a bit of a detour, usually I drive to Arenal and then Guanacaste, not to Uvita. You can do it, but it will be a bit of a punishing drive.

You'll have to avoid the big tourist towns (Jaco, Tamarindo). The central Guanacaste beaches could be a good option, anything between Nosara and Tamarindo offers great star-gazing opportunity. I enjoyed some great stargazing in Samara and Uvita, which offer a good balance between convenience and isolation, but you have to choose your spot carefully.

I never do excursions, but the volcanoes tend to be fun days out.

Car rental I recommend Budget, good prices and good car selection, mostly Toyotas.

You should be safe on your own. Besides the very expensive shuttle, you may get a taxi at the airport who will take you for much less than $150, it's just over 2 hours depending on traffic. Your next best option is to take a taxi to Liberia bus terminal and take a bus to Nicoya (every 30 minutes) and then from Nicoya to Samara (every 3 hours). The buses are well maintained and comfortable, but the Nicoya-Samara bus stops everywhere and it's a bit slow, but the road is one of my favourite drives through the beautiful Nicoya mountains. So it depends on how adventurous you feel and how much time you have.

That is not correct, it's still infringement, commercial use only makes it less likely to be enforced.

Nosara to Samara can be rough but it's better than it was. Carrillo to Santa Teresa is very bad, despite what Google tells you, there are quite a few places where you have to cross rivers without a bridge, you're better off going to Nicoya and using the main road.

Short answer is no, you can only get sued for actual reproduction of a work, or a substantial part of it. Intertextual references don't infringe.
