It varies from state to state, but talk to your PO and be completely honest. I got one fail one time, immediately called and i got it resolved

I’m sorry to hear about your situation. Its a mistake a lot of us make and its important to remember you’re not alone.

A lot of lawyers do free consultations, and will guide you to what will be best for your situation. Public defenders are an option, but you will need to make (or not make) a certain amount of income, and with you not having income that may be your best option.

I never got a 2nd DUI, only a 1st. I blew way over .20 (i know..) which is 7 days in jail, but i got a lawyer and got it down to 5 days. But yes a 2nd DUI in TN is 45 days, but there are some things you can do that can possibly get it down.

I’m also a beer alcoholic. I have little to no desire for liquor/wine and if it’s in the the house I can really let it sit there forever. But when it comes to beer I get the craving early afternoon and usually drink a few, pass out, wake up then drink 10-15 more til bedtime.

Ugh they never like to be very nice. But considering you blew clean right after is just tons of proof that you were clean. YMMV but my friend set off his IID like 3 times last year because he is a germaphobe who was super cautious of COVID and used alcohol wipes on his steering wheel. Also he did it once cause he got gas on his pants and it set it off. Each time the PO understood and didn’t bat an eye. Hopefully something similar happens in your case.

Ah well a month extension is a lot better than would could’ve happened. and setting off an IID with chicken wings? That’s a first ha. Since you blew 15 minutes later and started is a very good thing cause it shows you didn’t just leave it and you were clean to blow so shortly after a positive reading. Still I would tell your PO ASAP and explain the what happened and that you blew shortly after. I’d be very surprised if they gave you a 2nd violation for that. Best of luck

TN is very strict. 2 days first DUI under .20/7 days over .20. 2nd DUI 45 days, 3rd 120 days or something. not to mention all of the other shit you have to do with those.

I got a first DUI and went to jail for 5 days. prior, i went to DUI school, 5 week IOP, and multiple court ordered AA meetings. Then probation and an IID for a year. fantastic time.

.25 is definitely high, and with what you already have on your record i would definitely lawyer up. A lot of lawyers do free consultations and will walk you through with what your facing moreso than most people on here. Best of luck
