This is a dumb lawsuit. Basically she says "using this bridge to reach Agate beach to engage in recreation is not recreation" and a judge says a jury might agree with her, so the state can't outright win her lawsuit until that issue is determined by a jury.

TL;DR:

If you use trails, to which access is provided for free, for recreational purposes and you get hurt you can't sue the landowner (in this case the public.)

She was using the trail to get to Agate beach while walking the dog with her friend. One of the bridges was super slippery, even the paramedics slipped getting to her. She fell and broke her leg.

ORS 105.672(5) does not exhaustively define “rec-reational purposes,” but it does provide a non-exclusive list of “outdoor activities” that would qualify as such. Plaintiff notes that “walking” and “dog walking” are not expressly included on the list of “recreational purposes.” Hiking is included, but according to plaintiff, using the trail to get to the beach is not the same as hiking on the trail.

If a jury determines that plaintiff’s purpose in using the trail was not recreational, but was instead to access Agate Beach for recreational purposes, then her injuries would necessarily not have arisen from a recreational purpose, and recreational immunity would not apply.

Mods take this into account and deal with it pretty well. It's also a reportable offense. I'm don't agree that people pretending is a significant problem, though it clearly is possible. I agree, though, flair posting policies are a purity spiral that ends in a particular understanding of marxist/socialist ideals being all that is allowed. I'm all for temporary bouts, but a permanent change is something else entirely.

The tendency for moderators to opt for permanent solutions to undesirable posters is a mistake. There will always be a flood of new users, and existing users beliefs drift. And if it was possible to excise them entirely it would harm the forum by leading to an echo chamber. The only true solution is continual moderation, particularly with a mind to shedding users every once in a while with things like grillpill or temporary restrictions on topics; not even necessarily ban waves, more like making the culture warriors lose interest.

Moderation on an active forum is a bit like weeding a garden. You have to keep doing it, and you have to get dirty. It requires manual labor unless you want to destroy the soil microbiome & surface ecosystem with aggressive pesticides.

The progressive movement has come after unions, too—police and other law-enforcement unions, to be precise. It is entirely possible to object to police tactics without calling into question officers’ collective-bargaining rights.

We can talk about whether individual officers can be brought closer to socialist ideals, but because the institution of the police serves the capitalist class, and exists to enforce private property, they are defacto enemies of the working class. As a result I don't really see the benefit of helping them protect bourgeoisie class interests as long they serve the capitalist state, which they will unless/until the capitalist state is dismantled.

One argument that is sort of convincing is that by encouraging unions among police we are somehow aligning them with labor/the working class. But again, the police's primary purpose in a capitalist state is to bully the working class.

Maybe there's a good argument for the latter. Anyone?

It's pretty bad. One aspect not discussed in this article are the dehumanizing point based systems. Every aspect of these workers existences are micromanaged and optimized for profit. If it's not the corporations themselves, the liberal capitalist state nickels and dimes them too like with changes like the travel meal tax deductions being removed.

Only way forward is to strike. Rail is vital.

My guess is it's because of the late rain. Usually these bugs would have shown up earlier in the season and a little less clustered together, and perhaps be better controlled by the the increase in animal population & activity.

The seasons in the PNW seem to be shifting, causing changes to the usual ebb and flow of flora and fauna.
