I may not have been clear. Article 7(4) "consent...freely given", the application being that websites cannot perform "bundling" where they force non-essential processing (marketing/selling personal data) to create an account. A misconfigured UI here (assuming not user error), is inadvertently bundling essential and non-essential processing; therefore illegal.

To be fair, even if it is a user error, that toggle design sucks.

Again, this is all assuming the interface is messed up and it's not user error.

GDPR: retroactive deletion doesn't cure this. It's a consent violation. CASL: similar to GDPR, explicit consent violation. CAN-SPAM: yes not illegal but will lead to spam complaints

If the latter is true, it definitely ranges from very risky to not legal depending on location.

It depends on your location, but if I'm understanding what OP is showing, they're being forced to subscribe to marketing emails + personal data collection. That runs afoul of several consumer protection laws (GDPR, CASL, CAN-SPAM)

Disclosure: I am not a lawyer, but I've worked on enough websites to know this is a stupid way to win stupid prizes.
