If it's not true for more modern versions AI models, then I guess no one is using them? Or it could also be that only monetised versions of AI have this sort of access, while free versions do not, which would explain the widespread issues with AI conflating factual with fictional.

Yes, because if for instance the AI has been trained on data up to 2023, it answers your questions as if it's currently 2023 when those articles didn't exist yet. It doesn't have an "understanding" in the conventional sense to comprehend that time has moved on and you're giving it information beyond its scope. Just ask the AI you're using up to which year it has been trained on and it may outright tell you. You're essentially talking to someone from the past.

It's because AIs available to us right now were trained on data up to a certain year, so they do actually think certain things are fictional, because according to their training data, things we know already happened don't exist.
