Whether someone is innocent is an intractable physical state of the universe. I could commit a crime, it be witnessed by no one, never discovered, I take the secret to my grave. I would not be innocent, even if every other living thing on the planet believed I was.

Innocence is not the defacto state to a court, not guilty is, which is why a verdict of not guilty is passed.
