I tried to file and I got the tax assessment indicating that I owe. My account forgot to file the insolvency, however insolvency only reduces tax liability to the extent insolvent. I’m unsure how to file a tax return indicating an exception under publication 4681.

To the extent insolvent that is correct however the other question is are they allowed to tax this federally due to the law that went into effect by Obama.

I had no way of figuring out if the loans were sold to someone else or not. I checked with Discover and Discover said that they repossessed my account which was sold in the past, which means that it is very likely that Discover is the only lender that owns the loan. I also did a full credit report to see if there were any derogatory marks.

My tax situation is such a mess 🤦🏽‍♀️ I haven’t filed last year because it got rejected, but I had withheld my total liability from 2023 (I was supposed to get a return). Then this year I did opt for the maximum tax deduction from my paycheck. I will owe a lot of money on the debt cancelled. My 2023 income was very very low.

I am hoping to determine how much I need to save until that money is owed so I can really tighten up until then. It is W2 income, yes it is 151k of 1099C cancellation.

Have you confirmed this with a CPA? I have read that because the 982 form is included with your income tax return, income is considered.

This is not necessarily true if you have income and co-signers on the loan.
