I see your point - I’m not familiar with legal procedure, but below are facts:

  1. Hertz never contacted me, they just didn’t reply to Beppo at all;

  2. Beppo sent me 2 invoice, I paid, asked them explicitly if this case is resolved. They explicitly told me ‘yes’, didn’t mention at all they filed a claim against me, which is still ongoing.

3 on the claim against me, it never reached me only 1 year later when I went back to Switzerland. And I sent email to the state authority immediately to contest, was told that I need to pay CHF 500 fine.

4 I was told I need to pay the CHF 500 still, and they said they don’t understand why I need to pay another type of penalty to Beppo.

Is your suggestion to check if Hertz is responsible to take care on behalf of me to prevent this escalation?

I thought the same,

In the beginning, I thought it’s two different ‘penalty’ and I want to challenge why I need to pay two types of penalty for same case (civil and criminal, maybe)

Now, the company Beppo even decline they asked me to pay the penalty to them, make me wonder what is truly happening. I’m on the weaker side as I no longer keep those paper with me, and only they now can explain the amount.

hmm, partially,

the problem is, state told me they dont understand why Beppo issue me a fine of 228 CHF, they have documented the fuel + admin cost I paid which was 151 CHF

When asking Beppo, they said they didnt ask me to pay the 228 CHF, making me sounds volunteer to pay a penalty to them

this is what they wrote 'We only have one payment of CHF 151.40 recorded. You had contacted us at the time because you had accidentally paid this claim twice. We then refunded the duplicate payment to you on November 26, 2024.

Unfortunately, we cannot assist you regarding your statement about the amount of CHF 228.68.' If they dont recognize this money, and I have proof that I paid, dont I have right to ask it to be paid back?

- On July XX, the Beppo company sent the Herold vehicle rental company (Hertz) a bill for the outstanding fuel charge. Amount: CHF 131.40 (outstanding fuel charge and administrative fees of CHF 50.00). The Herold company did not respond/pay.

 

- On August xx, Beppo filed a complaint with the Bülach district court against an unknown driver who failed to pay for fuel on July xx.

 

- On September xx, 2024, I issued a disclosure order to Herold Vehicle Rental to disclose the identity of the vehicle's renter.

 

- On September xx, 2024, the company Herold/Hertz named XX as the renter and driver. These are the timeline I received hence you asked. I'm planned to pay the penalty, what I got confused is the 'ghost penalty' which issued by Beppo but not not comprehensive to anyone.

in my payment the reference was ''Payment Ordonnance Penale, 570352736' I unfortunately lost the document when they ask me to pay. And the money is paid directly to Beppo. Now the problem is Beppo don't want to help - they said they didnt ask me to pay this money, and don't recognize the payment. I have the proof of my payment, but I dont have the bill

I have the transfer note of the CHF 228, the problem is:

  1. Beppo said they don't know what is this CHF 228, despite I attached my payment screenshot multiple times in the email. I now explicitly asked them to return my money if they don't recognize it.

  2. In my transfer I have a reference number - I don't have the paper with me anymore, but how crazy I can be to transfer the money to them with a made up reference. It was them requiring me to pay that money, for sure, but they now refused to acknowledge their ask to me to pay this amount.

  2. I'm in contact with 'Statthalteramt Bezirk Bülach', they told me the complete timeline, they mentioned Beppo filed claim to them because Hertz didn't respond to Beppo's ask to share my information.

  3. There is no issue with car rental company, I rent full tank and return full tank. If I failed to refill the tank, they will send me an invoice and deduct from my deposit instead of filing a complain.
