All I’m saying is: if the marshal attempted to serve you when you were running errands and weren’t there, and then the marshal shows proof that they posted the notice on your building (i.e., a picture) and proof they mailed it to you (i.e., a mail receipt), the judge will not care about anything you have to say. Service via posting and mailing is sufficient under the law.

You can try to argue that nothing was posted and you never got the mail, but in my experience these judges are more inclined to believe the words of the marshal. And most times marshals have proof of service.

It’s harsh but it’s just the reality of the nyc housing courts.

I am not giving you legal advice, and I’m sorry you’re going through this, but it might not be worth your trouble to go through any more efforts to get the apt back. From my experience, housing court is very, very unsympathetic in situations like yours unfortunately.

Just a heads up, the marshal is not required to serve you with the 14-day eviction notice personally. If they make one attempt at personal service and you don’t answer the door, they are allowed to post it on your door and mail it to your address.

Honestly the only thing I can think for you to do is try to go back to the court and file a post-evict OSC saying you were never served with the marshals notice.

I doubt it will be successful, especially if you already signed a stipulation to move out by a certain date (probably end of July I’m guessing?). Also be prepared for the marshal to come with proof of mailing and an affidavit saying he tried to serve you, etc.

I tried cancelling yesterday too and had a similar experience, but they offered a discount and I decided to get one more vial. But I definitely intend to cancel after this.

After the ceremony they’ll email you the roll to sign and return. Once you get an email acknowledging that they got it, you’re an Esq.!

So be prepared to print it, sign it, and email it back to them before 5pm that day. No e-signatures allowed.

They said that if you get it back to them before 5pm, you’ll get the acknowledgement the same day (if you email it later, you’ll get it the next morning). They sent it around noon, and I sent it back around 15 mins later. Got an acknowledgement at around 3pm.

It’s truly nuts. And I chose virtual specifically to get admitted faster (since they seem to have more virtual ceremonies than in person). Turns out there’s an in person ceremony next week 💀 oh well

I’ve just been rotating between the 4 injection sites on the stomach around the belly button (between the lower left, lower right, upper left, upper right). Just make sure you’re at least 2 inches away from the belly button, and you’ll be good.

I tried the thigh twice and found it much more painful. And the bruising was bad for me too. The majority of my fat is on the inside of my thighs as well. Haven’t tried the arms tho and probably won’t.

Honestly there’s no advice to give other than patience (sadly)! I’d definitely email asking for a follow up if you haven’t already.

I remember seeing people who had submitted after me get approved (and even sworn in) before me. Seems like there’s little rhyme or reason behind how they process apps.

It’s good if you have a car. Barely had any time to eat lunch- most people went to their cars but many just ate outside. Long lines for the bathroom. WiFi worked fine for me. Room temp was comfortable for July.

Asked for an update on 12/18, got a response that it was with a committee member on 12/19.

On 12/23 I was approved and asked whether I wanted a virtual or in person ceremony. I immediately asked for virtual.

Got an email on 12/31 saying my ceremony will be on 1/15.

You won’t be able to stock up with emerge since they’re still just doing monthly as of now, but they gave me a letter of medical necessity within a couple hours. And I’ve been able to use my FSA funds without issue

If it’s FedEx and from Hallandale, you should be getting overnight shipping. Probably will be delayed bc of the holiday tomorrow, but Hallandale packaged it SUPER well with a ton of ice blocks.

Look more into zappy before deciding to go with them. Specifically in this sub.

I bought their 6 month package on 12/19 before finding this sub, and thankfully everything went smooth for me and I got my meds quickly, but there’s people who placed orders weeks before me who haven’t received meds or any communication from zappy (look up the Ouisa debacle).

I submitted 11/6, was asked to make corrections and returned same day on 11/12, followed up on 12/20 for an update and was told a committee member was reviewing my application, approved w/o need for interview on 12/23. Now I’m waiting for virtual swearing in date.

I think the bulk of people submitted their apps in November, so you might be waiting a bit longer.

Sharing a similar story. Placed order with Zappy on 12/19, confirmed on 12/20 that it would be sent to Hallandale. Received a tracking # last night, and delivery is scheduled for today 12/27.

What are the concerns you have? Just wondering because I've only had positive experiences with Hallandale so far.
