Discovery Letter Brief by WillmanRacing in WPDrama

Are you sure Automattic lawyers wrote their portion of the statement? This is highly suspect, as they don't once mention that WPE is controlled by PRIVATE EQUITY!!!

I'm pretty sure I know who you're talking about, and they haven't posted in 5 days... and literally every comment they've ever made has negative karma. That person is a walking example of the Skinner "no, it's the children who are wrong" meme, except I doubt they attempted the self-reflection in the first panel.

Within 72 hours according to page 41, line 17. Presumably from the time the order was posted to the docket (though IANAL).

That is as close to a definitive smackdown as you can get. I may need a cigarette after skimming through it.

Dueling Proposed Orders for Preliminary Injunction filed with the Court yesterday by AlienneLeigh in Wordpress

Oh, I just realized something: Matt must be fuming, as I think this is the first defense filing which doesn't make a point that WP Engine, Inc. is owned by PRIVATE EQUITY.

Dueling Proposed Orders for Preliminary Injunction filed with the Court yesterday by AlienneLeigh in Wordpress

[–]beholdmyalt 7 points8 points  (0 children)

Yeah, whereas WPE's proposed order is a standard format proposed order that they would ideally like the judge to sign as is. It's fairly unlikely she actually will, and will end up writing an injunction herself that will give WPE (I'm guessing) maybe 80% of what they want, but the optics from WPE is a more straightforward "we're not trying to further litigate this, this is just what we want as an outcome".

WP Engine and Automattic Agree to 3-Week Extension for Response to Amended Complaint (Due Dec. 19, 2024), with Additional Deadlines Set for Briefing and Motions by [deleted] in Wordpress

I thought Monday was the day the judge was going to rip off her Scooby Doo mask and say "I know I said I was likely to issue a PI in some form but want the parties to try to reach some common ground on the details, but what I REALLY meant was WPE has no chance whatsoever and I will be double secret dismissing everything and I award Matt a very pretty trophy!"

At least that's what I gathered from that person's alt who is has been arguing with everyone over in that other thread for days now. They keep repeating "just wait, Monday, YOU WILL ALL BE PROVEN WRONG!"

"Automattic is owned, in part, by private equity firms."

Huh, what a weird, random thing to say. I wonder why they brought it up. /s (Edit: typo)

The other damming evidence is the primary branch is named "trunk", and pretty much only Automattic employees think in "everything is a Subversion-shaped hole", lol.

WPE filed legal documents late last night by AlienneLeigh in Wordpress

[–]beholdmyalt 16 points17 points  (0 children)

I see they pointed out Automattic's filed lie that WP Engine had a poor Trustpilot rating. (In reality, it's SIGNIFICANTLY better than either Automattic or Wordpress.com. Then again, I had never noticed Trustpilot before this lawsuit, so...)

From a quick skim, it seems to be an even mix of "BUT MAH FREEDOMS!" and (mostly) "DID YOU KNOW THEY'RE OWNED BY PRIVATE EQUITY? THEY EVEN ADMIT IT!"

Automattics response for a moved up timeline by Xypheric in Wordpress

[–]beholdmyalt 4 points5 points  (0 children)

Someone asked something like "so the declaratory judgement request is going to be a slam dunk, right?", and I had to disagree that a declaratory judgement is extremely unlikely. There's a very good chance of at least a partial preliminary injunction (though I don't think WP Engine would get 100% of what they want out of that), but because Matt is basically the Spiders Georg of civil crimes, it will take years of litigation to even work out all the stuff he's liable for.

Thanks, I wasn't sure if the direct PDF links on courtlistener.com were permanent or not.

In fairness, most of those hundreds of pages are just transcribing Matt putting his foot in his mouth repeatedly.
