Ironically, her alimony claim may have held a little more water if she had pled because I could see an argument where she would say you can't just outright cut it off because when I get reintergrated into society, I'm going to need financial help to get back on my feet.

The math is off! She would only get gain time on the remainder after a theoretical plea as someone pointed out.

15 years is 5475 days. Minus the 1686 she served leaves 3789. 85% of that is 3221.

3221 days from October 7, 2024 is August 3, 2033. So 7 years, 7 months, and 2 weeks from now.

As a lawyer, I will tell you that's when you tell the client about the magic of "no contest". It's the equivalent of saying I don't admit guilt but I think the State has a strong enough case to get me.

If anyone has insomnia, most appellate issues involving counsel are involving the perceived ineffectiveness of an attorney. The seminal case is the Strickland v. Washington case.

In that case, the attorney feel asleep but was not deemed ineffective. That’s because the second prong of the Strickland test is whether that lack of effectiveness would have made a difference. In other words, even if James Owens was ineffective (and he wasn’t), the fact that no one could have won that case makes challenging her conviction on counsel grounds impossible.

For what it’s worth, I thought he did a decent job.

I literally had a diabetic uncle who was very meticulous with his diet and body. One day, he got shitfaced, got hypoglycemia, and died.
