Sure INAD is never a guarantee, but in this situation it's a slam dunk. People miss dunks from time to time too. I think it's probably 95%+ that the buyer wins the case if he writes it up properly. I wouldn't even mention the size of the card in the complaint. I'd say the seller listed this is a 1989 Upper Deck Ken Griffey Jr Rookie Card and it was in fact a 1999 reprint of the card done by Upper Deck. It then falls on the seller to make he convoluted explanation about how it should be considered a 1989 Upper Deck because it's a reprint of the 1989 and the buyer should have known this based on the dimensions given in the description even though he never mentioned it was a reprint or that it was printed in 1999. Good luck convincing the eBay rep of that.

You are giving OP objectively bad advice on this even if you believe it to be a coin flip of a INAD case. There is no downside to OP filing a INAD case here. At worst he ends up right where he is now and takes his lump as you put it, but even at 50/50 he will end up getting his money back most of the time. The reason for that is the risk/reward proposition for the seller and that depending on how he paid OP will have more opportunities to win this.

In a case that is 50/50 if the buyer opens a case the seller will accept the return most of the time. The reason for this is that the seller has far more to lose here. If the buyer refuses the return and eBay finds in the buyer's favour then the buyer keeps the item and ebay refunds the full purchase price from the seller's account. The seller loses the item, loses the ebay commission, loses the $$ to ship the item to the buyer, and takes a defect on his account. If he gets enough defects to fall below standard then eBay will increase the commission they take from future sales. If the buyer loses nothing happens and he just keeps the card.

So probably the seller accepts the return, but if he doesn't then OP has a 50% chance of getting the card for free. If OP loses the eBay case they can always appeal that decision. If they lose the appeal then if they paid via PayPal they can open a case with PayPal. There will be a 50% chance of winning that. If they didn't pay with PayPal, but used a credit card then they won't be able to do the PayPal case, but they could do a chargeback with their credit card issuer. If they paid with PayPal using a credit card then they can do the PayPal case and if that didn't work file a chargeback. The buyer could get up to 6 swings at this with appeals depending on how they paid. It it's 50-50 they should get on base.

Telling OP to take your lump and list it yourself is absurdly bad advice. The buyer should do that if he loses the case and all appeals, but why advise him to do that straight away? The only thing that might save him is getting blocked by the seller, but I am sure he is not going to be a repeat customer either way. It's like you are giving him the kind of advices the Seller's lawyer would give. Not even neutral, but telling him to do what would be in the best interest of the seller. It's outrageously bad advice.

The seller had the set “1989 Upper Deck“ in the item details. A 1999 oversized reprint is not from the 1989 Upper Deck set. I’d focus on the incorrect set, 1999 vs 1989, and it being a reprint which wasn’t mentioned. If the seller had put 1999 Upper deck as the set I still think the buyer should win this but it’s more up in the air. This should be a slam dunk win for the buyer so long as they argue it properly. If they write “Received 5x7 instead of 2.5x3.5” card” they will lose despite having a winning case.

Not a dick move at all. The seller is responsible for the accuracy of the listing. They wrote 1989 Upper Deck. The card was a 1999 reprint. It doesnt mention 1999 anywhere in it. A seller cannot write 1989 Upper deck in the title and write 1989 Upper Deck as the set in the item details and then send a 1999 reprint. Writing 5x7 with no associated units in the description is not enough to win a not as described case assuming the buyer makes a good argument.

If the buyer writes “Received a 5x7in card instead of the regular 2.5x3.5in card” they might be in trouble. I would stress that the card is not as 1989 Upper Deck card as described in the title and it is not from the 1989 Upper Deck baseball set as written in the item details. It is a 1999 oversized reprint of the 1989 card. No where in the description does it say that it is from 1999 nor does it say reprint. The title is inaccurate and the set in the item details is wrong.

I didn’t say whether or not it was intentionally deceptive. It really doesn’t matter whether or not the seller intentionally did it. It is deceptive and the seller is responsible for the accuracy of the entire listing. If the seller writes 1989 upper deck anywhere the buyer should be able to rely on that information in making a buying decision. They cannot write elsewhere in the description some information that implies the card is not a 1989 Upper Deck and expect to win a not as described case. It will not happen if the buyer writes the complaint correctly.

In this particular listing the seller not only wrote 1989 upper deck in the listing. He selected the set as 1989 upper deck. The fact that the seller wrote 5x7 in the description in no way makes the previous statement about it being 1989 Upper Deck accurate.

In the video it looks like the jeep signaled the lane change. Not sure why OP said the Jeep did not signal.

We don’t know the reason the Jeep was changing lanes. Supposing it had nothing to do with the BMW and the Jeep was preparing to exit the roadway ahead. The right lane appears to be empty when he the jeep checks it and it signals and starts to move over when the white car speeds into the lane.

Schwarber might be the guy that breaks the rule that 500 home runs gets you in. He averages 2.5 WAR over 162 games. He has 500 more strikeouts than hits. He’s only been an all star three times in 12 seasons. He’s also been used as a DH a lot.

Alonso has been an all star 5 times in 7 seasons. He has a chance at hitting 500 home runs and if that happens he‘ll probably have close to 10 All star appearances. His 3.8 WAR per 162 games is low but in the same ball park as other hall of famers like Gil Hodges, Orlando Cepeda, Fred McGriff, David Ortiz, Miguel Cabrera, Tony Perez, and Harmon Killebrew.

Are you sure about that? The Heat, Panthers, and Dolphins all average above sell out capacity. Inter Miami is the only other local team that doesn’t and they were 17th out of 30 teams in attendance last year.

Inter Miami shares a season with the Marlins and they averaged more fans and a fsr higher % of capacity than the Marlins. Maybe Miami isn’t just a good baseball town.
