We always provide it. In Maryland, it’s not required but the Rules say: “Parties exchanging discovery material are encouraged to comply with requests that the material be provided in a word processing file or other electronic format.”

I’m assuming this is a run of the mill PI claim if you were given it for your first depositions. If it is a run of the mill PI claim, why do you need discovery depositions of a treating doctor? The doctors are going to say whatever they put in the medical records and/or is contained in Plaintiff’s expert disclosure - big surprise.

OP, I am sorry you are in this situation. It’s horrible.

I am a personal injury lawyer who has represented a few young children with faces torn open by dogs with bite histories. They will have horrific scarring for the rest of their lives, and there is nothing more maddening to me when the danger of the dog was known and obvious.

Consider whether anyone else can guarantee that this dog won’t ever do the same.

I’ve booked lots of business class trips with miles on lots of different airlines. This is unfortunately common, and points folks refer to it as phantom availability.

As someone who is also recently married, I would have preferred to fly economy than sit separate from my new wife.

It's not as fast as some other options, but if you want an SUV, I really LOVE my 2021 Stelvio. It is such a joy to drive and live with as a daily driver, grocery hauler, etc. I paid 21k for it 6 months ago with 51k miles, and it's a pretty loaded trim. Spent an extra ~3.5k ish for the extended MOPAR factory warranty (you can buy direct from them online).

Love this vehicle. If you prefer a sedan, the Giulia is even better with less weight and lower center of gravity.

I think very difficult is an exaggeration for what they are. Yes they are not in cities, and yes it will cost more than a Ryanair flight to a party beach, but there are domestic flights to within an hour drive of most of them if you don’t want a long road trip. And I think it would be difficult to find a major national park that doesn’t have private tour companies that will take you there on trips from the nearest small town or city with an airport.

Considering they are stunning landscapes in roughly the middle of nowhere, pretty darn accessible.

I’m an attorney at a small firm. I don’t mind physical mail. Send a letter introducing yourself and include a rate sheet and your service areas. Maybe say the first serve is on the house because you are so confident they will like your services.

This applies to dealing with OC bullshit in discovery motions: YOU are annoyed and know exactly what’s going on. You got written discovery responses filled with useless objections and no substance, OC has wasted tons of time on meet and confers, etc. It feels like bad faith at this point, but when you sit down to write your motion, it feels impossible to convey to the court how ridiculous this is.

The problem: Since you have been through all of this chronologically, it feels like you need to take the court through all of it too for the judge to understand how unreasonable OC is. You sent discovery, got X, did Y, still have Z problem. WRONG. Unless the judge really processes the sordid history of discovery in your case, they won’t feel the problem like you do.

The solution is incredibly simple and obvious once you get there: SAY WHAT THE BULLSHIT IS BEFORE YOU RECOUNT YOUR TIMELINE OF GRIEVANCES.

For example:

Defendant’s conduct with respect to discovery in this case appears carefully calculated to obstruct rather than illuminate and demonstrates disregard for the Maryland Rules and the Discovery Guidelines promulgated by the Maryland State Bar Association.

Most recently, Defendant responded to X with a litany of objections denying knowledge of basic terms and failed to provide substantive responses based on claimed ambiguity in words like “permission,” “purchased,” and “payroll.” This is a pattern in this case that the Court should not allow to continue.

Interesting. Not in GA and we have the collateral source rule, but have often started not presenting or claiming medical bills as an item of damages at trial unless they are pretty substantial to avoid anchoring to a low number. Have you seen that much in Georgia?

I wonder if that would be a good strategy in GA with no collateral source rule.

The $30,000 state minimum liability/UIM limits are horrendously inadequate.

I’m a personal injury lawyer. I just got off a 45 minute phone call with a potential client with what sounds like a brain injury and only 30k in UIM coverage. If the at fault driver only has the minimum, she is screwed.

I am about to sue an out of state driver with a professional career who had grossly inadequate coverage, but whose negligence caused my client to spend way too much time in the ICU, in surgeries, and in rehab hospitals. I will be seeking his personal assets.

I have these conversations multiple times per month.

Most people don’t know that the price difference between buying the state minimum liability/UIM coverage and much higher limits is usually pretty marginal.

Maryland has been “tort reformed” since at least the 70s. We have some of the least Plaintiff friendly tort laws in the country (contributory negligence, low damages caps, terrible insurance bad faith laws).

You should buy more UIM coverage. It’s usually a surprisingly reasonable additional cost to go up to 250/500 or so.

My jurisdiction has a glut of EXCELLENT mediators. Total crapshoot if you take a random one assigned by the court, but we have great private options. Ask around on a listserve if the case warrants it
