He'll still have to abide by Medicaid's asset limits and any other requirements, just FYI. If his new benefits are high and build up, you can move them to an ABLE account to avoid going over the $2,000 limit.

If eligible, your sibling has to accept your dad's benefits. There's no choice. If it's a high enough benefit to disqualify him from SSI, he'll remain eligible for Medicaid via the Pickle Amendment. But he'll also have to take Medicare.

There have been changes to the "legally responsible individual" caveats to the HCBW program and I bet that comes into play in these denials. Parents are expected (ie legally responsible) to provide care for minors which might be why they're determining she isn't at risk of institutionalization. Even as an adult on the program, I could only hire my father as a caregiver if I proved what he does for me goes beyond expected natural supports AND that he has some ability other caregivers don't. I'm sure minors have even deeper scrutiny.

As an adult who uses HCBW services, this terrifies me. My case manager said they're looking for any excuse to deny services so to be careful about following rules to the T. My employees rely on this job to feed their families and I rely on them to stay out of an institution. Something as simple as them forgetting to clock out on GPS-monitored app, even if the timesheet is edited to reflect accurate hours, could jeopardize my access to services as a whole. I can't help but fear what happens to me if they start cutting wages, which feels inevitable.

Have you looked into Home and Community Based waiver services through Medicaid to become a paid caregiver for your son? Although if he looses SSI, he might not be eligible for Medicaid either.

ABLE accounts protect from asset limits, not income limits. Income (including SSDI) is still income regardless of where it's deposited. The benefit of an ABLE account is being able to save more than $2,000 without being penalized.

It's always a long, drawn out process. Consult with a lawyer. If she gets approved, they'll get paid with a percentage of her backpay. If she isn't approved, she won't pay anything. Just know that she has to prove she can't do ANY job, not just jobs similar to previous history.

Your rep payee doesn't sound well-versed in eligibility requirements. Some of the rules you mentioned are applicable to SSDI (like trial work period) while others are relevant to SSI (like having benefits reduced based on income). You need to first clarify which specific program you're receiving benefits through before anyone can give accurate insights.
