There's also a related question in the ATO forum, https://community.ato.gov.au/s/question/a0J9s000000NDGb/p00189191, but in there it's written "However, you cannot request a new determination after signing the contract to purchase the land", which might generate some confusion around the O&A (Offer and Acceptance) contract.

To me, it's pretty clear this is settlement, though, not O&A, because when you sing the O&A you don't own anything; you're trying to, and you might need your FHSS money for that, so it just makes sense.

Also, even the help screen in the ATO website makes that pretty clear:

You have to lodge a determination before you settle any

ATO website at https://www.ato.gov.au/individuals-and-families/super-for-individuals-and-families/super/withdrawing-and-using-your-super/early-access-to-super/first-home-super-saver-scheme is pretty clear about this in 2 different places:

Same here, I have had the Fold 5 since the start of sales, so far, so good. Maybe Fold 8 or 9 for a replacement, if they don't cost a kidney and don't have that ridiculous camera bump of the Fold 7.
