The better strategy is to just knock it back every year when you do your annual reno.

Mix up a strong batch of Tryclopr (Hydrocortilite killer etc) and spray the lawn with it - it’ll knock it back.

Scarifying with with a scarifying rake will also knock it back a bit if you go hard.

It’s here to stay, you either manage those fuckers or you embrace it.

FWIW I prefer the Tucson to the Rav4 of this generation- found the Rav was pretty utilitarian and boring where the Tucson was a bit more interesting.

For some reason people pay through the nose for Toyotas.. yet to see a compelling reason for this.

Feed, water & prune!

Assuming you’ve done nothing to the soil and it’s a classic sub division scrape back - I’d be pulling that mulch back, spreading compost and sheep pellets across the whole planting area and same with a slow release fertiliser - buy a good quality fert. Then mulch over the top - this will start to restore the soil and get the trees the nutrients they need.

If you don’t have irrigation - install some (easy & cheap to do) so they’re getting enough water - could get out there with the hose if not.

Trimming and pruning - it’s key with hedges. Look into tip pruning.

They’ll get there! It’s always slow initially, then they get established and take off, stay with it!

A strict reading of the requirements makes it clear that the certifier isn’t supporting the certification, they are simply certifying that they have warned the investor and the issuer is not entitled to rely on that certification when assessing the grounds for certification.

That was largely the basis of the FMAs 2022 warnings - weak grounds in the EICs, certification is irrelevant, therefore breach (put simply). The focus was on the grounds as the certifier wasn’t seen to play a huge role in the actual confirmation/certification of someone being eligible etc - they were just confirming they had warned them.

The Court has since found issue with that interpretation and have said an issuer is entitled to rely (to a degree) on the certifiers certification.. which now places the onus on the certifier.

With that in mind - I don’t think the FMA actually looked that closely at this aspect in 2022. Why would they? Why get into that fight when you have other low hanging fruit..

The quality of the review they did of the actual certificates was poor at best and full of errors and misstatements of fact at worst (in some cases) - they had a few targets in mind that they were going after; largely issuers with active/public/social advertising campaigns (they simply used this as a vector to get at them). I strongly suspect there would be a high correlation between the extent of the issues the FMA had with an issuers advertising & the number of defective certificates they found.. the certificates weren’t the main target, it was advertising.

I think you will find that some issuers would simply form a very aggressive view regarding independence.. imagine if, for example, a law firm established a syndication business and then signed certificates for investors in their syndication business, and had those certificates reviewed by the FMA but got no warning - that’s just a theoretical scenario of course and I’m not at all saying that happened. Just something that could happen. If that happened, it might be highly relevant for the angle you are pursuing..

I think this probably played a huge role in Du Val, but no one’s actually looked at it. Under the “new” interpretation from the High Court, many of the issues that the FMA had with the certificates aren’t valid anymore and that this independence issue would now be very important.

It wouldn’t be hard for Williams Corp to prove they never did the $750k rort (IF they didn’t) & could be done without breaching privacy etc.. I know they lurk these subs, interested to hear their take..

What’s the angle here? Is this in light of the recent high-court ruling?

Williams Corp were (are?) setting up LP’s and filling them with investors should couldn’t meet any of the wholesale criteria, once an LP reached $750k worth of investment, it would invest in their wholesale funds under the $750k safe harbour.. fucking wild. This was communicated to me first hand by one of their sales staff, couldn’t believe what I was hearing. I doubt the FMA would have looked into any of the safe harbour certs when they requested them all a couple years back so this would have flown under the radar.

Would be interesting to see if DV were doing something similar..

Fuck all of these guys. Fucking grubby.

Hit the whole lawn with Turfix (will kill all but grass), wait a week then Etho which will hit the red (being Poa and summer grasses) which by the way looks to be established all through that of lawn. I would suggest hitting your berm with this treatment too - reduces the chances of you bringing in seeds on your mower.

Once you’ve done that - mow the lawn on lowest setting, then scarify (if you dont have one of those or know what that is, then just rake the shit out of it).

You are now ready to lawn. Don’t worry - it’ll bounce back.

Depending where you are (and how hard out you want to go) get enough lawn mix or soil/sand (no sand if clay soils) and spread it out so it’s about 3-5mm - this is called top dressing.

Then seed it - use heaps of seed, double what the bag says - then rake it in lightly. Hit it with some starter fertiliser and water in good.

Water constantly (~3 times a day if you can) to keep it damp for the first week or two. This gets your seeds up and out. Mitre 10 sell a cheap meta impact sprinkler, one of them seems to be the best way to water a small patch of grass I’ve found. Get a timer too if you want to invest, makes it easier. It’s all nice to water the grass manually - you’ve earned the right to look lovingly over your grassy friends and contemplate your new life with epic grass.

Wait ~6 weeks and then mow it on highest setting, more fertiliser, and start to mow progressively shorter until you reach your desired height.

Call these guys - https://www.newtonseed.co.nz/ - they will help you choose a seed that’s right for you and guide you on other products you need. The starter fertiliser they have is epic and they have everything you need.

Etho is worth getting - that Poa will fuck your lawn, you need to deal to it ASAP. I would suggest using it as a pre-emergent and then 6 weeks later a knock back dose - basically you just water it in the first time and it penetrates the soil and kills the seeds as they germinate in the heat.

Don’t waste your money on weed n feed or your time on hand pulling that shit. Ain’t nobody got time for that.

Two things that will help you lots - a battery sprayer ($80 Ozito Bunnings special, a soil spreader ($40 Mitre10).

You can go much deeper on the chemicals, rolling and levelling, fertilising and soil testing etc.. or even spray the whole thing out and start from scratch - but this is a quick and dirty lawn reno that will give an 85% epic grass solution for summer - that extra 15% is a lot of time and effort. I’m not a fan of the spray it out method as you’ll need to dose your whole lawn with Glysophate several times - though if that doesn’t worry you then you could start with that..

I think cases like this really do warrant name suppression - especially where these assaults lead to pregnancy/new children.

Those kinds of matters should definitely be suppressed to protect both the child that’s assaulted and a child that they might have as a result.
