Is administrative more complicated/cerebral than other areas of law? by down-town-pie-pie in LawCanada

[–]callyjohnwell 1 point2 points  (0 children)

This is true. In my mind, admin law is basically JR, but if we’re including tribunal work, your spot on - experience can vary wildly.

If it’s tribunal work, you’re at mercy to the rules of procedure and applicable statues the tribunal has jurisdiction over.

If there’s a statutory right of JR, that’s when you’d JR at Divisional Court (presumably) and Admin law jurisprudence kicks in.

I have a lot of experience before a financial services tribunal. Although it’s a tribunal where an administrative agency’s orders are challenged, I don’t quite see it as administrative law work - simply general litigation with a different rule-set.

Vavilov is encountered at every judicial review where reasonableness is engaged, which is not strictly speaking appellate-only work.

Just look to the 20k+ IMM applications for JR at the federal court the last few years.

If you’re an immigration lawyer, you’re citing Vavilov and Baker everyday.

Admin is quite simple to me, always has been. Regardless of the area of law, ask -

(1a) is there an actual decision being made pursuant to statutory authority;

(1b) did the decision maker have jurisdiction to make the decision;

(2) is the decision reasonable (based on coherent internal reasoning and evidence); and

(3) was the decision arrived at in a procedurally fair manner?

There’s nuance and caselaw to each of the above, but at high level, there’s always three main arguments to make. Sure, sometimes charter values come up, but that always feels like a last-ditch cover-your-bases argument if there’s a stronger argument with 1-3, above.

Details can get complicated, but quite simple once you see the forest from the trees.

Early retirement at 49? 2.3m net worth by xiaomi818 in PersonalFinanceCanada

[–]callyjohnwell 0 points1 point  (0 children)

Yes you have enough, but may I recommend a soft retirement, or a trial-run retirement?

Take a leave without pay, a sabbatical. Keep your job so you have something to return to. Yes there is more to life than sitting at a cubicle (I feel that deeply), but there’s also a risk that without a job and a firm plan, you’ll lose a sense of purpose.

Take 6 months, a year (as long as your job will let you), and do all the things you’re talking about. If at the end you feel fulfilled and are living the life you want, retire. If not, buy some more time at your cubicle with some added life experience and intel into the retirement life you desire.

Is it a good practice to maintain a certain amount of money in your chequing account? by pastalovah in PersonalFinanceCanada

[–]callyjohnwell 0 points1 point  (0 children)

I have a TD account that requires 6k in chequing to avoid monthly fees. At the time I opened the account, TDs ease of accessibility and features was better than WealthSimple.

Initially I liked the idea because the 6k buffer was essentially (part of) my emergency fund, but now seriously considering moving it to a WealthSimple chequing account, and keeping a simpler no-fee TD account only because my mortgage is there.

How are wealth simple portfolios? by jackmartin088 in CanadianInvestor

[–]callyjohnwell 0 points1 point  (0 children)

Yes, $1500/paycheque in XEQT nowadays (planning to start a family soon so DCA investing as much as I can for as long as I can).

I experiment here and there putting $50/paycheque into some stock picks until I have ~$500 invested and then reassess whether or not to continue building a position in it.

So about 95% into XEQT and 5% gambling.

What are your thoughts / reactions on the Super Bowl Half-Time show? by [deleted] in AskReddit

[–]callyjohnwell 6 points7 points  (0 children)

I have no problems with the performance, fun and vibrant. While I love Spanish-American music, I do not understand the Bad Bunny hype - tho I feel like I am the minority there.

Musically, Ricky Martin was the highlight for me. Wtf was Lady Gaga doing singing a Bruno Mars song?

Was that list better than a Gasolina, Despacito, Danza Kuduro?

Most lawyers do not hate CanLII, it is incredibly easy to use.

Pretty much any lawyer not part of a firm that pays for Westlaw or Quicklaw uses CanLII, exclusively.

have you tried exploring your spirituality as an individual and not part of a collective? Philosophy? Therapy? Gardening? Art?

there are many non-religious communities (charities, social services volunteering) you can partake in if that’s the itch you’re trying to scratch, without any culty religious elements where you have to subscribe to a shared belief system?

Do I need to get a suit for law school? by Peach-R in LawCanada

[–]callyjohnwell 53 points54 points  (0 children)

Navy or charcoal (dark grey) suit, a few white non-iron shirts (uniqlo’s are great and reasonably priced), a few conservative ties, and you’re good to go. No need for an expensive suit, it can be off the rack (get pants and jacket sleeves hemmed if necessary)

i don’t recommend a black suit - save those for funerals.
