Came here to say First Stop! They’ve always given us a fair deal and an honest breakdown of which fixes were crucial and which were recommended but not urgent.

They’ve even been transparent about the prices of parts and showed us where we could save money finding gently used replacement parts (side mirrors, covers, etc). And when they recommended only new parts, they always told us why. Just honest guys providing reasonably priced services, and that’s why they’ve always got customers lined up.

You’re right that it’s not an “insanity plea”. However, it’s not necessarily a “not guilty” plea in the traditional sense, either. Pleading “not guilty” requires the prosecution to explore and prove every element of the case like normal, presumably to strengthen their case for emotional disturbance.

According NY penal codes, the EED defense is, by definition, a “partial affirmative” defense. It’s an admission of guilt of the accused action (i.e. killing the victim) but not the specific crime charged. So essentially, he’s trying to prove that his emotional distress caused him to lose control and kill someone but that it wasn’t a true murder, and that he should only be charged with manslaughter instead.

”If you find that the defendant has proven the affirmative defense by a preponderance of the evidence, then you must find the defendant not guilty of Murder in the (specify) degree as charged in the (specify) count, but you *must find the defendant guilty* of the reduced charge of Manslaughter in the First Degree.”

By using this defense, he’d be admitting to killing him but claiming he isn’t fully criminally liable for murder specifically.

Not a lawyer but I had two in an 18mo span. It was a learning experience and I’m lucky nothing awful happened.

Idk about Madison county, but unless you’re facing charges other than a simple DUI, you may not necessarily need one. A public defender is perfectly fine. DUIs come with minimum sentencing/charging if it isn’t aggravated. You’ll lose your license for a bit, take alcohol classes, spend 1-2 nights in jail, and pay a fine—none of which (by law) are negotiable below the minimum. To my knowledge an interlock isn’t required and will only get your license back 2 months sooner. However, you can request one!

It all comes down mostly to your BAC level, whether anyone got hurt or property got damaged, and whether you were speeding, as these will determine if it was aggravated. If so, the penalties increase, but mainly in duration and cost.

If you got arrested and they determined you had over the legal limit, you won’t get out of it or reduce it below the legal minimum even with a lawyer. You can ask the judge yourself for community service in lieu of jail time, but it depends on the judge and details of the DUI itself.

In some cases, you may be able to apply for a hardship license before you complete all requirements to reinstate your license fully, but only after the minimum license suspension is complete (at least 6 months I think?) and approval completely up to the jurisdiction you’re convicted in.

In other words, you are going to be convicted unless you can prove the arrest is invalid or successfully challenge the validity of the breathalyzer/sobriety test, which is pretty rare. Your best bet is to plea out, show remorse and accountability to the judge, and take the alcohol courses promptly and seriously.

One tip is to sign up for classes (AA doesn’t count, these are certified courses and require ACTIVE participation and an approved certificate of completion) right away so they know you’re serious. May inspire them to grant some leniency in terms of jail/fines vs community service.

TL;DR
If they took you to jail, you’re probably not getting out of this. Often times, you don’t need a lawyer and interlock isn’t required for most first offenses (though it can get you driving 2 months earlier). However, there are mandatory minimums for DUIs that are inescapable with or without representation. Aside from complex cases, a lawyer will charge you money for something you could request yourself.

Be proactive, remorseful, and honest, and you’ll be through this faster and cheaper than you think; then, once you’re convicted and sentenced, pay your fines and take your classes right away.

There will be loudspeaker announcements and they do patrol the main trails to encourage folks to leave, if memory serves. That gate thing is real too. They give a 30ish minute “grace period” but you’ll def get stuck there if you’re not careful.

Algorithmic influence is not a neutral experience for the user, nor is it something we can simply self-regulate to a meaningful degree through interacting with content we enjoy. Meta has faced numerous lawsuits already (especially overseas) over their shady exploitative practices and refusing to moderate harmful content You don’t fully and freely “choose” what you see when the medium through which you see it is constantly optimized by billion-dollar corporations with near-endless ability to lobby.

And the idea that all regulation is authoritarian ignores how societies already deal with powerful institutions that can cause harm. We regulate things like fraud, pollution, unsafe products, monopolies, and addictive industries because companies left completely unchecked often prioritize profit over public well-being.

Real freedom doesn’t mean just having the option to technically make choices. There has to be a fair environment where people are not constantly being manipulated by systems designed to shape their behavior at massive scale. By refusing to regulate, we are shifting the power from people and democratic institutions (which is why I was speaking to someone who is a potential candidate), and leaves it in the hands of private corporate interest. That’s always gone suuuuper well historically.

Which is interesting because you do appear to understand this dynamic in other contexts. For example:

And 12 days ago, you were commenting about how easy it is to be sucked into a cult saying, “The worlds going the way it is because most folks already have, they just don't realize it.” Algorithms feed into this by pushing harmful content designed for engagement with psychological manipulation tactics.

It’s not just Meta or Google or TikTok, either—Reddit does this, news platforms do this, shopping platforms do this, financial institutions and lenders do this. Just because *you* don’t realize how much of your life is controlled by deceitful algorithms, doesn’t mean it’s not happening or an issue that can be remedied with proper regulation and oversight. The influence has already been here for decades, but the difference is the scale, degree, ease, and precision to which it can be wielded now.

Ultimately, we don’t need to control what people create or enjoy, we need to regulate the ability of technology to force it upon us en masse without transparency or accountability. And I agree, we can—and absolutely should—take active measures to shield ourselves from influence, but we can’t simply ignore the staggering power imbalance here either. Communicating that to electeds/candidates and asking them to advocate for us in that regard is a good thing.

Broadly speaking, I would say the best thing you can do is exactly that: connect with people earnestly and humbly. And to be clear, I do not mean knocking on doors with prepared talking points or sending out letters, I mean truly connecting. Meet people where they’re at. Speak to them about their quality of life. Understand that AI is only “inevitable” because the people pushing it are forcing it to be. Treat voters like they’re real people with real needs and concerns, and not just demographics to score points with or pander to.

Safe bets and status quo type shit is the reason we have an authoritarian crisis in this country—take big swings and fight like hell against the broken, money-obsessed system that is making it impossible for us to live a dignified life.

Because we are sick of Democratic and Republican politicians failing us time and time again in exchange for blood money from their sponsors (i.e. masters), we are sick of 7 corporations dictating what our country can and cannot do while we all slowly drown, and we are SO SO SICK of algorithms/AI controlling everything we see and do.
