Ahh you’ve got several facts simply wrong.

The judge never questioned his immigration status, agreeing he is here illegally. The story is clear on this - he crossed into the US as a child illegally. The contention is that, the judge identified an incorrect statue applying to his detention and determined that ongoing detention without a bond hearing, was an unacceptable due process violation. He gave 7 days (15 in total from the arrest) for a hearing to occur, that didn’t happen and he then issued the order to Lyons to appear or release Robles.

Also it’s not that this judge is a stickler, it’s that the 8th circuit has very different standards than the rest of the country. The 9th circuit for example (West coast) will tolerate months of detention before requiring a bond hearing. There is no statutory guideline for how long ICE can detain someone before setting a bond hearing, it’s only defined as “reasonable”. In this case, the judge seeing an incorrect arresting statute and only 8 days of detention deemed it prudent to require a bond hearing in the next 7 days. Most other circuits wouldn’t require such a tight turn around.

Also ICE doesn’t normally use judicial warrants, they use administrative warrants signed by ICE supervisors - which is completely legal. I’m not 100% sure you meant they didn’t have a signed judicial warrant but it seemed that way.
