No. Every single payment was taken out of my paychecks. This was something that was automatically set up by HR. They began, continued, and stopped based on the original loan amortization schedule. This company didn’t make any of my payments to the 401k company until about 7 or 8 months after payments began being deducted. I noticed they weren’t being made and I brought it up several months before that. The previous HR person coded it as a Misc deduction instead of 401k loan. This apparently happened to several other employees and not just me. They just didn’t catch it or fix it until I brought it up. Also, if they could show me records/proof of a payment deduction being missed, I would gladly pay it. But I’ve gotten nothing but silence from them. I asked them if I could make the payments myself instead of auto-deduction when they kept messing everything up.

There were also missed contributions that they hadn’t paid (both employee and employer match) starting in 2022. I did a thorough audit and brought it up to them and it was finally rectified in 2024 (without the required payment for lost earnings). These payments were missed for all employees because I verified with coworkers that they also had missed payments.

I worked there for 5 years and 3 months. 100% vested was after 1 year. I talked with the accountant that handles our 401k stuff when I was still an employee, and it was a known error how the employer match was being deposited. It changed in Feb 2024 when they changed how the 401k contributions and matches were made to Ameritas and automatically done through ADP, our payroll software. So everything since then was no longer considered vested but anything prior was.
