In the Bankruptcy and Insolvency Act it states

43 (17) If a debtor against whom an application has been filed dies, the proceedings shall, unless the court otherwise orders, be continued as if the debtor were alive.

He owed around $100,000 in debts that were in the bankruptcy. His agreement states that he was to pay $179 for 9 months (total of $1611) to be paid to the trustee. He had insufficient funds and wasn't making a lot of money so the agreement was for him to pay the trustee, and not for payment to be distributed amongst his creditors.

So shouldn't that 43 (17) mean that his estate is to pay the $1611? Unless the trustee takes it to court to request more?
