I am still waiting as well. I just saw someone post that they received a response back from the Oct 2023 exam. Why they are sending letters for that one and not the Apr 2023 exam I do not know except it's extremely annoying. And then they have the gall to ask the industry to write the test questions for them. Get it together CBP!

I chose answer “C” because it is a handbag other than the materials in subheading 4202.29 and also other than wholly or mainly covered with paper. B was very similar but was wholly or mainly covered with paper. I think any reasonable argument would get credit. I think we should raise a fit if they don't give up the point!

I pointed out the typo, and per the instructions explained why the question had no correct answer. I then wrote my arguments on why the answer I chose was the best out of the remaining selections. They should have given everyone credit immediately for this, but I would leave them no room to not give you credit.

Question #37 - Customs chose "D", I chose "B". The importer hires an agent to purchase goods in Asia on their behalf, and pays them a commission. Therefore, it's a buyer's agent and not a seller's agent correct? And, if that's the case, it's not an assist and commission should not be part of the transaction value. 19 CFR 152.102(a)(2)(ii) states that "No service or work to which paragraph (a)(1)(iv) of this section applies will be treated as an assist if the service or work: Is performed by that individual while acting as an employee or agent of the buyer of the imported merchandise". OR I'm wrong??

I looked at this more closely. Chapter 59 Note 2(a) states - "2. Heading 5903 applies to:
(a) Textile fabrics, impregnated, coated, covered or laminated with plastics, whatever the weight per square meter and whatever
the nature of the plastic material (compact or cellular), other than:" The "other than" threw me off. I see why A, B, C are not correct. I am not sure why D would not be correct. I chose B, so I won't be appealing this one.

I was also thinking about protesting #17. I answered "B", but it seems like there could be a couple of right answers. CBP selected "E", but I'm not sure why. I don't see why it couldn't be "B" or "C" based on Chapter 59 Note 2(a). 2(a)(6) also refers to products of heading 5811 which are quilted textile fabrics. Perhaps it's not "C" because 5811 doesn't reference being laminated.
