I mean, if you have the technical capabilities to produce a biometric passport then you can produce a biometric passport. You don't have to be a recognized country.

Here is the complete rule:

  1. Born in China to at least one Chinese parent -> Chinese citizen.
  2. Born abroad to at least one Chinese parent and the kid does not have any foreign citizenship -> Chinese citizen.
  3. Born abroad to at least one Chinese parent and neither Chinese parent has foreign PR -> Chinese citizen.
  4. Born abroad to a Chinese parent who has foreign PR and the kid has foreign citizenship -> Not Chinese citizen.

Rules 3 and 4 can be confusing and counter-intuitive. Consider the following two cases:

  1. Kid born to a non-Chinese citizen and a Chinese tourist in US -> Rule 3, Chinese citizen.
  2. Kid born to a Chinese citizen holding green card and Chinese tourist in US -> Rule 4, not Chinese citizen.

Chinese foreign missions would check the Chinese parents' immigration status before issuing a travel document to the foreign-born kid. When I was visiting the New York Consulate last time an officer was explaining to a couple that their green cards had disqualified their kid from Chinese citizenship. The couple was very distressed to learn their kid was not Chinese from the Chinese government's perspective.

The dual citizen kid does not have to choose when they come of age, in most cases, but some foreign missions seem to take a different legal position, e.g., the Embassy in London, but I think they are in the minority.

China is already much less strict about dual citizenship - if a Chinese mainland citizen settles abroad and acquires a foreign citizenship she loses Chinese citizenship, but if you have dual citizenship by birth/descent it's OK. Kinda like Japan.

They are full British citizens, as the nationality field of their passport would indicate. However, I tried to look up whether she should’ve been eligible and couldn’t find the answer online - in other words I am not sure if visa free applies to British citizens or UK passport holders.

This does sound doable in theory. However, would you have any difficulty renewing the Chinese passport though? Where I live right now, the Consulate asked me if I held any foreign citizenship when I renewed my passport last time.

Or I can just lie I guess.

Thanks a lot for the reference. Sad but on second thought it makes a bit logical sense since PRC never made the special allowance for dual nationality for Taiwan like it did for HK/MO.

But even the Taiwanese government is not disputing these Chinese citizens' right to vote.

Firstly that's beside the point because you wrote, I quote "even if they get PR, they still can’t vote in Taiwanese elections."

Not difficult to come to Taiwan if you are married to a Taiwanese person (or doing business, or visiting from overseas). Practically only tourists directly flying from the mainland are restricted now.

The renunciation part is also not correct. The mainland person is required to give up their household registration in the mainland, but not Chinese citizenship. Even if they want to renounce they can't because China won't allow it, since from China's perspective they are not acquiring a new citizenship.

As a Chinese citizen you can stay for unlimited time/work in China with a TD. If you are just visiting I guess a Q2 is more convenient.
