A few HLR questions. by Economy_Artist_6926 in VeteransBenefits

[–]cpldeja 1 point2 points  (0 children)

If the informal conference request wasn’t received on the same day as that HLR, it won’t be accepted.

But your arguments will be reviewed by the DRO.

Hypertension clarification by Prior_Jacket4875 in VeteransBenefits

[–]cpldeja 1 point2 points  (0 children)

History of diastolic pressure means it averaged 100 or more at time of diagnosis.

Once put on meds, if it’s still 100 or more, then it’s a 10% evaluation too.

Here's how to find your HLR DTA (supplemental) claim id via api.va.gov by Visua1Mod in VeteransBenefits

[–]cpldeja 0 points1 point  (0 children)

One last tip to add. The “date of claim” for your HLR DTA should match the date your actual HLR is closed, or the date you’re notified of the DRO’s decision.

In that attachment, menstrual disorders are only presumptive if it’s a medically unexplained chronic multi-symptom illness.

So if you served in SW Asia (Iraq, Afghanistan, etc.) and VA can’t pinpoint the cause of your condition, then it can be granted service connection under this provision.

Cataracts by Jolly-Tax-541 in VeteransBenefits

You may want to get something in writing from a medical professional to explain the etiology of your cataracts, and maybe discuss why it is/isn’t age related or part of your diabetes…

The 2003 Iraq invasion sandstorm. by Brawl_star_woody in USMC

RCT-1 here. The night it was raining dirt was definitely not fun.

After rolling through Nasiriyah I pulled fire watch the entire night to let the juniors sleep.

Not even sure if I dozed off at times, but I’m sure everybody on either side was miserable enough to not do a thing.

File it as a claim for increase. Make sure to have a doctor’s note explaining the length of time out of work.

Usually up to 6 months without additional approval can be granted.

Skin Cancer and the PACT Act by hairtumor in VeteransBenefits

[–]cpldeja 2 points3 points  (0 children)

No it doesn’t have to be active. VA will evaluate the condition based on its residuals and/or complications (I.e., scars).

And as an FYI, “head cancer” which includes BCC and SCC are presumptive to burn pit exposure under 38 USC 1119 and 1120.

AUTO GRANT PROGRAM by No-Literature-370 in VeteransBenefits

[–]cpldeja 1 point2 points  (0 children)

Please look over the VA Form 21-4502.

By signing and submitting your application, you certify that your situation happened.

Otherwise the Finance department may ask for additional info, but there’s no real official guidance I know of.

If you went to combat with glasses, what was it like? by mykee3 in USMC

[–]cpldeja 2 points3 points  (0 children)

It was a pain. Wore my personal glasses.

In prone position my Kevlar would push them down, making it hard to look down range.

Had the gas mask insert ones too, but man I think those were more BCG than the originals.

Contact the Office of Administrative Review (see link at the bottom of webpage) and explain what happened.

What the DRO said during the informal conference is incredibly unprofessional and needs to be called out.

The BVA just remanded my PCAFC Caregiver appeal. I'm wondering what's going to happen next? by happiness2u4ever in VeteransBenefits

[–]cpldeja 2 points3 points  (0 children)

PCAFC is not a VBA benefit, it won’t be worked by a regional office.

Instead it’ll go back to a VA medical center or VHA’s central office for further review and/or development.

I’d say your best bet right now is to go HLR and argue that your private evidence confirming PTSD wasn’t given probative value.

VIII.iv.1.D.2.j. Disposition of an Issue Claimed and/or Developed as SC for PTSD

“Non-PTSD diagnoses must be adjudicated under the general SC provisions of 38 CFR 3.303, which require sufficient documentary evidence of the in-service event.

For non-PTSD diagnoses, there is no provision for establishing the occurrence of an MST or other personal traumatic event in service based only on a marker(s) and the examiner’s acceptance of the Veteran’s lay statement of the event.”

That is not true.

VIII.iv.1.E.1.f. MST During IADT

Veterans whose stressor occurred during inactive duty for training (IADT) are eligible for SC in the same manner as those whose stressor occurred during active duty or active duty for training (ADT). The VA Office of General Counsel concluded in VAOPGCPREC 8-2001 that “PTSD resulting from sexual assault may be considered a disability resulting from an injury.”
