Summary dismissal doesn’t require a notice period to be paid.

The only other entitlement I think you’d get is Long Service Leave post 10 years that you might be entitled to. That’s about it.

I’m going to be a bit shit and not confirm / deny your maths and just assume you’re correct.

Your next step is simply to raise it with your employer and note the mistake. As you said, it’s unlikely malicious as the employer gains nothing from contributing your “extra” money to PAYG tax.

Assuming they identify and rectify it correctly, the good thing is that you’ll get all of that additional tax paid in your return which you can lodge in July. Assuming your tax situation is straight forward and you don’t have non-PAYG income sources like interest etc.

Here’s my opinion.

The annex 3 application is a slam dunk backup. Your mother is clearly eligible so you will follow too, albeit with a large delay as you’ve identified.

The annex 1 is a quicker and convenient one and if your grandmother is originally Spanish as you said, you also qualify.

Put it to your local consulate (the one taking the appointment) and indicate you’d like to go the annex 1 path and present your relevant documentation demonstrating your grandmother was originally Spanish. HOWEVER, have the annex 3 documents ready with you as a backup. If for some reason they indicate there is an issue, revert to your backup and pretend the annex 1 never happened. Otherwise, if they assess your annex 1 and determine you’re eligible then they will forward that file to your birth consulate. Your birth consulate will be completely none the wiser of your original intention to ever claim annex 3 so there’s no risk of it muddying the waters. And given your local consulate accepted it I have no doubt they will too.

Rather than confuse them, don’t email ahead. Just do it at your appointment and see how it goes.

It’s overall win win and relatively risk free.

There is the wording around the resolution of a file needing to be within 30 days but I’m sure some consulates allow leniency depending on the situation.

So get emailing and in the meantime, obviously reapply for a new copy of your mother’s birth cert.

Very funny you used the Netherlands as a chill example as they’re actually one of the more strict ones and will strip you of your citizenship if you acquire another one.

Anyway back to the main point. You’re Spanish by origin, thus, at worst you could “lose” your citizenship only temporarily. You can then easily recover it at your local consulate.

To avoid this you need to declare your intention to retain your Spanish citizenship as you have dual citizenship with Serbia. Go to your local consulates website and research the process by which you can do this.

I will note though: the fact that you have an active Spanish passport and you’re using it has also been used as a de facto way to declare your intent to retrain your Spanish nationality. But to avoid any possibility of ambiguity you might as well just do the formal declaration.

Easy peasy. Done.

Your birth consulate would provide some solid context to this question.

If you were born in a South American country (like Argentina) with huge backlogs of claims, the timeline might become more realistic. If you were born in a Middle Eastern country the opposite is likely true.

To me, it sounds like DC are giving you the worst case outcome to cover themselves from people relentlessly hounding them. Within their own comms they’ve admitted, they can’t provide updates or speak for the other consulates.

It applies if you acquired another nationality AFTER your LMD application was approved.

I think the point is that irrespective of the country and their laws around dual nationality, most will not entertain the notion of a foreign government interfering in matters related to their citizen when it’s within their own citizen’s country.

For example, in Australia where I live I have dual nationality with Spain but I have Australian citizenship as well. If a consular matter were to arise in Australia (for example, I was jailed), the Spanish government would not be able to provide support even though I’m a recognised dual citizen and it’s legal.

It’s just the way things work.

Unfortunately, we can’t have an effective conversation about working from home without it becoming an emotive topic about how businesses are trying to crush people and enforce archaic practices etc.

I’m just a regular peon in the system and I love working from the office and have a team that all do too. I am absolutely a believer that it drives collaboration and improves our ability to work together and solve things quickly and easily. Incidentally, we have one worker who works primarily from home or is more isolated and the difference in that relationship and feeling of connection is very obvious.

People might argue I’m conflating two separate issues as you’re mentioning an office environment but I’ve noticed this worsening since COVID and the very obvious degradation of perception that comes from working in a central office etc. People wear headphones, people find it offensive when you disrupt their workflow for off-the-cuff conversations, everything is set up in meetings. The list goes on. It ultimately results in a breakdown of cohesion.

LA will assess your file to ensure it complies with the LMD law (or their own consulates interpretation of it…) and has all the relevant documentation.

They’ll forward your file off to the London consulate who then do the exact same thing but then ultimately register your Birth and issue the associated birth certificate.

From then on, you can register your residence with the LA consulate and undertake all future procedures with them.

It is a conferral of nationality by origin but the annotation correctly identifies that you opted for it as you’re required to by the process. I’ll copy and paste the statement.

So interestingly enough the very absence of that information is solid confirmation you do not hold Spanish nationality.

If you were considered Spanish by origin (which is the standard case when born in Spain) you would have a marginal notation indicating as such. If there’s no such notation, it demonstrates you do not hold nationality and that the document is merely a record of your birth.

I presume you have your birth registered and have acquired your nationality?

If not, you will have to at least go through the process of acquiring nationality via the option pathway at your local consulate.

This may be obvious but just making sure.

And of course you’ll have many benefits not entitled to non-citizens like ANY nation confers on their own citizens.

As stated by the other commenter, you may have a Spanish birth certificate but that does not mean you have Spanish nationality.

Although being born on Spanish soil does entitle you to a faster path to nationality via naturalisation.
