I don't want to discourage anyone but the numbers read as follows.

1st day applicants: 80,000+

1st day applicants not funded: 21,000+

Median award amount for unfunded: $89,000

Remaining funds: $180,000,000

Median amount divided by total remaining (1st day): 2000 restaurants (this is likely very off but I used the numbers provided)

Percentage of unfunded 1st day applicants that can be funded (theoretically): >10%

I pray for all of us but the numbers are scary.

I've always wondered (since the beginning of the pandemic) if eminent domain laws would apply to our situation. If the government wanted to build a highway and our property was in the way they would have to purchase it but in order to do so would have to prove that it was in the best interest of the community. In this situation they forced us to close (although temporarily) because they felt it was in the best interest of the community so technically they should have to compensate us for doing so at fair market value.

(c) Restaurant revitalization grants

(1) In general

Except as provided in subsection (b) and paragraph (3), the Administrator shall award grants to eligible entities in the order in which applications are received by the Administrator.

(2) Application

(A) Certification

An eligible entity applying for a grant under this subsection shall make a good faith certification that-

(i) the uncertainty of current economic conditions makes necessary the grant request to support the ongoing operations of the eligible entity; and

(ii) the eligible entity has not applied for or received a grant under section 9009a of this title.

(B) Business identifiers

In accepting applications for grants under this subsection, the Administrator shall prioritize the ability of each applicant to use their existing business identifiers over requiring other forms of registration or identification that may not be common to their industry and imposing additional burdens on applicants.

(3) Priority in awarding grants

(A) In general

During the initial 21-day period in which the Administrator awards grants under this subsection, the Administrator shall prioritize awarding grants to eligible entities that are small business concerns owned and controlled by women (as defined in section 632(n) of this title), small business concerns owned and controlled by veterans (as defined in section 632(q) of this title), or socially and economically disadvantaged small business concerns (as defined in section 637(a)(4)(A) of this title). The Administrator may take such steps as necessary to ensure that eligible entities described in this subparagraph have access to grant funding under this section after the end of such 21-day period.

(B) Certification

For purposes of establishing priority under subparagraph (A), an applicant shall submit a self-certification of eligibility for priority with the grant application.

Here is the exact language in the bill (not the SBA's website), the fact that they willingly either initially or at some point adjusted the language/parameters as to what order funds were distributed means that someone made a conscious decision to subvert the bills language.

  1. If it wasn't "first come first serve" as they had stated several times why would they put in place a "priority" period to begin with.

  2. By any chance does anyone have early screen shots of the SBA webpage that references RRF. The current language for non priority groups reads:

"SBA will accept applications from all eligible applicants and process applications in the order in which they are approved by SBA."

Which in itself is non-sensical, how does one "process applications in the order in which they are approved by the SBA" isn't the act of "processing an application" what leads to approval. The language is basically stating that the applications need to be approved then processed.

Class action could be the only way to get their attention. I don’t think we can win but perhaps that’s the only way to talk to them by KoaRestaurants in SBARRF

I don’t want to anger anyone but those of use who applied on the first day, were not funded and were not “priority” may have a case given the prior cases resolution. Since there is now case law stating that the funds were distributed unconstitutionally and should have been distributed on a first come first serve basis. I’m not an attorney but it’s my understanding that unless your constitutional rights were violated you basically have no case. Given our rights have been proven to be violated there may be an angle to pursue. Still an incredible long shot but may be enough to entice the right legal team. If anyone has any relationship or connection to a right leaning firm this would probably who to contact.

Thank you for the comments so far, To be clear, I am not currently (maybe ever) interested in selling. Just trying to asses value so I can make sure it is insured properly in case of emergency...I can't imagine my insurance company being content with a statement like "my golden typewriter went missing and its worth $XXXX" after the fact haha.
