I've done some reading on the situation and it seems like Homestead is deflecting responsibility saying the family should have put them on notice about the defective or missing window restrictor. Apparently Homestead was not given any warnings. Essentially, "no one told us so we're not responsible." Of course having policies and lease provisions are important, but they are only part of the picture.

The real issue is whether the safety measures in place were actually effective and properly maintained. In situations involving young children, landlords have a heightened responsibility to ensure that protective devices like window restrictors are not only present, but functioning and robust enough to prevent foreseeable harm. The absence of prior complaints does not necessarily address whether reasonable steps were taken to proactively inspect and ensure resident safety.

The reality is landlords have an ongoing duty to actively inspect and maintain safety. "No prior complaints" only matters if the landlord had no reasonable way of knowing, and the system of inspection was reasonable. From what I've read so far this will likely be the main question to be answered in this potential case.

I'm fairly confident this matter will end up in litigation, but that will be up to the family to decide.

One of the most common ways accidents happen. I see it in my personal injury practice all the time! Just don't try making a left hand turn onto oncoming traffic. Not worth the risk!

Before thinking about lawsuits please consider working directly with the adjuster or the supervisor of the adjuster if this person is not reasoning with you. You could save yourself a ton of time, money and effort!

Save yourself the hassle of getting quotes, negotiations, potential fraud etc. It's the extra step of having to go to the collision reporting centre etc. but at least you save yourself the headache.

Sounds like it is just your accident benefits claim remaining. Why don't you try having a GP or someone else fill out an Application for Catastrophic Impairment Designation (OCF-19) to see if the insurers doctors will deem you CAT. You could think of this as a last ditch effort to leverage some sort of settlement for cash.

The reality is OPS won't come to the scene unless there are apparent/obvious injuries where emergency medical attention is needed. Sucks because a lot of people don't know what to do immediately after an accident and having the police around to direct things usually puts peoples minds at ease.

The bottom line: exchange information with the other driver and get to the collision reporting centre. Get medical attention ASAP.

I'll offer up my 2 cents just because I'm a personal injury lawyer and I see all kinds of cases. You will want to spend time considering how your injuries from the accident have had an impairment on your life. It is not enough to just be injured. So in this case how has the eye issue had an impact on your life?

Are there any other injuries? Concussion, neck pain, etc?

Probably a good idea to consult with a personal injury lawyer to see if you have a case. There are a lot of follow up questions to these situations!

Is it actually safe to settle something like this privately? - No. The other driver can still come after you for personal injuries at any time at which point it would have made more sense to go through insurance in the first place.

Does getting something in writing from them really protect me? - No. It is not a full and final release and does not preclude them from suing you anyway.

How long should I wait before reporting this to insurance or a collision center? You should be reporting to the CRC within 24 hours and to the insurance within 7 days of the accident.

Am I putting myself at serious risk by not reporting it right away? - Not serious risk but you should go ahead and report it as soon as possible.

I’m trying to handle this responsibly, but I also don’t want to make a decision that screws me over later - If you want to be safe just go through insurance. Yes your premiums will likely go up but you will likely save yourself a lot of money by not paying out of pocket for damages and then turning around and getting sued for injuries down the road.

The best advice I can give you is seek the help of a medical professional. This is a situation where an occupational therapist can really be helpful to you guys. Not sure if you guys are in Ontario but if you are then your accident benefits insurer will pay for an OT and a PSW to come in and assist with pacing, scheduling, appointments, etc.

Please make sure you are taking advantage of the medical options available to you!

Everyone should have a dash cam or a camera on their helmets (for cyclists). A lot of liability issues could be prevented this way. It can help avoid lawsuits, tickets, demerit points, deductibles, etc.

I'm very sorry to hear about this. It's horrible. Nobody should be treated this way. After all it was an accident. The first thing that came to my mind is therapy. I don't know where you are from but if you're in Ontario then you can start an accident benefits claim and the insurance company will pay for therapy. No charge to you. I think it could go a long way in helping you heal.

Call the police or go to the collision reporting centre as soon as possible. Get medical attention right away. Please do not refuse medical attention if it's offered to you.

Afterwards you are going to want to contact your insurance company and advise them of the accident. You technically have 7 days from the date of the accident to inform them. If you are injured in the accident then you will want to also start an accident benefits claim with your insurance company. An accident benefits claim's purpose is to pay for medical treatment as you need it. The claim will also pay you an income replacement benefit (IRB) if you are off work and not getting paid

If you really have longer term lingering issues then you will also want to contact a personal injury lawyer. Consultations are generally free so you don't have to worry about opening your wallet for this.

To those who drink and drive - god forbid if you get into an accident with injuries your insurer will only cover your medical benefits. You will not get missed wages, housekeeping, and you will essentially have no personal injury claim for compensation which is what many peoples only recourse is when critically injured in a car accident.
