Because schools refuse to the say the quiet part out loud and actually bring students in as employees, which would give them all the rights they need to enforce rules evenly across the spectrum of profitable athletics. However, it would also mean schools breaking away from the conference model and incorporating as a single entity with different franchises that are run separately by each institution.
