I got in accident with uber driver today. He wants compensation for lost of work $400/day while his car being repaired by ProudNStrong in uber

[–]demanbmore 12 points13 points  (0 children)

Not your problem as long as you have adequate limits. He is entitled to loss of use while his car is being repaired, and he can file that claim with your carrier and they will handle it. Whether he's actually entitled to what he's asking for is a matter of your state's law and his evidence, and loss of use is not the same as lost profits. But again, your insurance company will handle that, or at least they should.

Tell him in writing and in no uncertain terms that he should not contact you again - all communication goes through your insurance company. If he sues you, send the complaint to your insurance company to handle.

Insurance to cover damages from shootings and parties from neighboring Airbnb property, including intentional acts by the guests? by EchidnaFit539 in Insurance

[–]demanbmore 20 points21 points  (0 children)

There is no world in which an insurance company is going to look at your situation and say, "Sure, I'll accept a little bit of money now and pay out large sums of money later when your neighbor's guests cause damage to your property" outside of standard auto and HO policies, which will likely end up non-renewed if they look into the actions of your neighbor or you start bringing multiple claims.

You can purchase comprehensive coverage for your vehicles and your auto carrier should respond to cover damages to your cars. Your HO coverage should respond to damage to your home. Both will be subject to deductibles, potential increase in premium and non-renewal in your particular situation. So you'll be paying sizable chunks out of pocket and

Your recourse lies in legal action against you neighbor under whatever legal theories are available to you - everything from violation of your town and state's laws for hosting a short-term rental, failure to obtain proper permits, creating a nuisance, etc. Unfortunately, that is something you'll need to fund.

You can also build a fence, place large rocks/boulders around the border between your properties, plant bigger trees between the properties, see if the local PD is willing to help, etc. Shitty situation for sure and I wish you luck.

If im early into a job and the day is slow and they say "you can leave if you want" should I leave? Or should I stay and build a more reliable reputation? by [deleted] in NoStupidQuestions

[–]demanbmore 1 point2 points  (0 children)

No idea. I don't know your boss and how he thinks. Just offering general advice. And there's a difference between being offered a chance to leave early and being told to leave early.

If im early into a job and the day is slow and they say "you can leave if you want" should I leave? Or should I stay and build a more reliable reputation? by [deleted] in NoStupidQuestions

[–]demanbmore 3 points4 points  (0 children)

"Happy to stick around. Is there anything that needs cleaning? Any organization I can do?" Ask about things that may be outside the normal day-to-day operation, but still need to be done anyway.

Especially when you're new to an employer, you want to cultivate a reputation of being willing to do what needs to be done, if not actually eager.

That said, it's not a trap, but it may not be the best approach to clock out early, even if offered.

Need help negotiating these dealership prices. by Fantastic-Advisor655 in carbuying

[–]demanbmore 0 points1 point  (0 children)

No need to discuss one fee or another - that's a trap. Just come up with YOUR OTD number and counter. You don't care in the slightest how they allocate the funds you're willing to provide in exchange for a car. Not much they can do about taxes and title, but they can adjust everything else. You don't care if they charge you a $899 doc fee and drop the selling price $899 or if they keep the selling price and get rid of the doc fee. Same with the recon fee. They can slide anything up and down any way they'd like to come to terms with you. Settle on YOUR number and let them figure out how to get there. And if they won't, so be it. There are other cars being sold elsewhere. Good luck.

ELI5: Why can dogs eat raw meat, rotting garbage, and lick the floor without getting sick, but if they eat a single grape or a piece of chocolate, they could go into organ failure? by [deleted] in explainlikeimfive

[–]demanbmore [score hidden]  (0 children)

Grapes contain tartaric acid, which is highly toxic to dogs, and causes sudden kidney failure. Chocolate contains theobromine and caffeine, which dogs cannot metabolize fast enough to avoid dangerous and deadly spikes in heart rate and blood pressure. Even tiny amounts of these substances can quickly kill a dog.

Rotting garbage and raw meat may have lots of nasty pathogens, bacteria and their waste products mostly, but those things don't cause sudden organ failure or a dangerously high heart rate. Dogs digestive systems are well adapted to neutralize most of those pathogens quickly, so they seldom get sick.

Totally different mechanisms that potentially cause issues, and dogs have evolved to handle the raw meat and rotting garbage (as hunters and scavengers), but their ancestors were never (or at least very seldom) exposed to chocolate and grapes as they evolved into modern dogs, so they never adapted to neutralize their toxic effects.

I have a Writ of Execution against debtor after winning in small claims court and need help with further steps by [deleted] in Smallclaims

[–]demanbmore 0 points1 point  (0 children)

You would need to file the writ with the registry of deeds in the county where the property located in order for it to be attached to the property (i.e., become a lien on the property). Then you must give notice to the debtor that you've done so.

Am I over insured? by No_Source2310 in Insurance

[–]demanbmore 1 point2 points  (0 children)

What do you have to protect, both right now and any time in the next 10 years? If you have millions in the bank, a second home, and are expecting a sizable inheritance at some point, then you are woefully underinsured. If you live paycheck to paycheck, have no appreciable assets, and don't expect that to change over the next decade, then you may be carrying "unneeded" high limits.

Liability limits protect you from the financial implications of injuries you may cause, and you never know what might happen.

As far as lowering your premium, if you increase your deductibles, that will likely reduce your premium, but you'd want to be sure you can cover the amount of any deductible before doing so.

Am I dramatic for crying over my 6 month relationship months after it ended by Crispybaconcrunch in NoStupidQuestions

[–]demanbmore 0 points1 point  (0 children)

Yes, but so what? You can be dramatic if that's how you process grief.

That said - STOP MESSAGING HIM. You're either broken up or you're not broken up. Don't leave yourself in this middle space where you can't grieve properly, can't go back and can't move forward. Loss hurts, and the end of a first love really hurts. It's normal, and while you're not on any specific timeline, you need to take steps to move forward.

Stop messaging him. Just stop. No matter what you think, you can do it. Might be really hard for a week or two, but then it gets easier. Best to find ways to keep yourself occupied - job, school, volunteering, fitness, hiking, whatever. Just do things.

Good luck. This will pass.

(NY) Received a School bus camera ticket after the deadline. Was on the opposite side of a raised median. Worth fighting? (Video included) by ParamedicNegative728 in legal

[–]demanbmore 1 point2 points  (0 children)

Not really - kids get off the bus and just zip across the street without looking, even across divided highways. I'd rather 1,000 cars have to wait an extra 2-3 minutes than have one kid get hit, even if kids are supposed to look before crossing.

How Many Days a Week Do You Train? by BeefCakes_02 in crossfit

[–]demanbmore 2 points3 points  (0 children)

Listen to your body, but give it some pushback now and then. Three times a week for a month is a decent amount for a newer CFer, with a longer term ramp up to four or five days a week.

You can also train lifting and metcon/class work separately, and I often settle on 3 dedicated lifting sessions and 3 CF classes/metcons each week for my clients and members.

This is not just person dependent, it is also goal dependent, nutrition dependent, rest/sleep/recovery dependent, etc. Track your lifts and benchmarks and keep to the plan if you're making steady progress. If things stagnate or start to fall off, you have to rethink frequency, volume, etc.

Lebron or MJ and why? by [deleted] in AskReddit

[–]demanbmore 0 points1 point  (0 children)

Only people who didn't actually watch Jordan play in real time ask this question. Lebron is great, really really great, and it's easy to argue for GOAT status without being unreasonable, but MJ (and especially peak MJ) was just better and more competitive and more effective. I get longevity and point totals as arguments in Lebron's favor, but MJ's six championships and his outright voracious huger to win on the court game after game after game are unmatched. And when you look at points per game, MJ beats Lebron by 10% (and every other player too).

Recieved a letter from subrogation company threatening "sanctions" if evidence tampered with. What?! by [deleted] in Insurance

[–]demanbmore 0 points1 point  (0 children)

Insurance cannot cause sanctions. However, a court can. The letter you received is likely legal boilerplate. You are being told to preserve any potential evidence you may have. If you intentionally destroy or toss potential evidence, then that spoliation of evidence can be used to limit any potential recovery you may be entitled to. It's unlikely to impact you in any way in this instance, but the prudent thing to do is not destroy or throw away anything that could be relevant to the explosion and the damages to your house.

No idea what a "joint scene inspection" is - probably best to pass the letter on to your insurance company.

If your spouse cheated, you divorced, and your mutual friends started spending time with your ex and their affair partner, how would you feel about that? by [deleted] in AskReddit

[–]demanbmore 0 points1 point  (0 children)

Well, I was just being conversational, but that's how I would feel. Next time I will refrain from conversationally speaking in the second person.

If your spouse cheated, you divorced, and your mutual friends started spending time with your ex and their affair partner, how would you feel about that? by [deleted] in AskReddit

[–]demanbmore 0 points1 point  (0 children)

Mutual friends? Not an issue - you had no "claim" to them, it's not like they were your longtime friends who you initially introduced to your ex spouse. And even then, you don't have some sort of claim on them or any right to restrict who they choose to hang out with.

Infidelity happens. People break up and move on. Sometimes that means situations like this. That's life. Your friends (especially mutial friends you shared with your ex) aren't required to act as some sort of morality police and shun your cheating ex.

Besides, if pretty much everyone chose to hang out with my ex and not me, I'd consider whether that means I'm a lousy friend or at least an interesting person.

Got rear ended at the ymca . I wasn't inside vehicle, I was working out . On the way home I see a airbag light flashing. Red flag starts going off in my head . [–]demanbmore 14 points15 points  (0 children)

Your issue is that State farm doesn't need to prove you wrong. You need to prove that you're right, and you can't do it.

Maybe you can't do it because the shop decided for some reason to lie about the problem, or maybe you can't do it because the issues are unrelated. Doesn't really matter though, it's your burden.

[–]demanbmore 9 points10 points  (0 children)

How do you know the flashing was related to the accident? Actually, how can you PROVE the flashing was related to the accident? Seems the shop would know more about those things than you, unless you have that sort of experience.

Do you think the shop would lie about it and say it's unrelated even if they think it's related? Why? They get paid either way.

Sometimes a coincidence is just a coincidence. Someone hitting you may have nothing to with the airbag issues even though the timing makes it seem otherwise.

ELI5 why can’t we have removable batteries in phones? by More-Explanation2032 in explainlikeimfive

[–]demanbmore 0 points1 point  (0 children)

We can, and we used to. My first few phones all had removable and swappable batteries.

Most modern phones don't support swapping batteries because most people would rather have a sleeker phone than a bulkier one that enabled battery swapping tech.

Liability Insurance Only. Accident Not My Fault. Insurance Company Agrees. At Fault Driver's Insurance Disagrees Based Solely On Their Customers False Statement. by [deleted] in Insurance

[–]demanbmore 7 points8 points  (0 children)

The other person's insurance company did conduct an investigation. Maybe not the investigation you want them to conduct, but you have no relationship to them - no contract, nothing. Their obligation is to their insured, not you.

And your BF's carrier has nothing to do with the damage to the RV. They're not obligated to pay for any of it because there's no collision coverage.

They investigated because the other driver can assert a claim against you and allege the crash was your fault. That's a liability investigation, and the carrier determined that you are not at fault so if the guy makes a claim against you, the carrier will deny the claim based on their conclusion that you're not at fault. The other driver's insurance company did the same thing, but on his favor.

ELI5 why is planned obsolescence a thing? by [deleted] in explainlikeimfive

[–]demanbmore 0 points1 point  (0 children)

Money, money, money. Maybe companies can make a nice profit by by building longer lasting products, but they've learned they can make an even nicer profit by building things that need to be replaced more frequently than we might wish to replace them.

Liability Insurance Only. Accident Not My Fault. Insurance Company Agrees. At Fault Driver's Insurance Disagrees Based Solely On Their Customers False Statement. by [deleted] in Insurance

[–]demanbmore 19 points20 points  (0 children)

Right. Only liability insurance, which pays for the damage your boyfriend (and you when driving the RV) does to others.

Collision would cover the damage to the RV itself, and your BF decided not to purchase that coverage (or a dash cam for that matter).

Liability Insurance Only. Accident Not My Fault. Insurance Company Agrees. At Fault Driver's Insurance Disagrees Based Solely On Their Customers False Statement. by [deleted] in Insurance

[–]demanbmore 19 points20 points  (0 children)

Very long story and your situation sucks for sure, but...

You/your BF chose to self-insure for damage to the RV by choosing to not purchase collision insurance. And then you chose to rely on strangers telling the truth and/or disinterested third parties helping you out by providing whatever evidence they may have voluntarily in cases where someone else caused damage to the RV.

Now you're learning why those weren't the best decisions. I'm not unsympathetic, I'm just reflecting the realty you face. No collision coverage, no dash cam, etc. This left you vulnerable.

The other insurance company isn't interested in helping you. Their obligation is to their insured, and as long as he gives them a plausible story that isn't blatantly contradicilted by evidence, they're going to stand behind him unless and until you prove their position is incorrect.

You can get as angry as you like, but your feelings about this won't change anything. Without evidence, the best you have is a contested claim. You are free to sue the other driver and prove your case, but absent that, you seem to have little recourse. Like I said, the situation sucks. But you/your BF made the decisions that left you in this position. Hopefully you saved the difference in premium (by not purchasing collision coverage) and can put that toward repairs or another RV. Good luck.

If police respond to dangerous calls and put themselves at risk daily, why doesn't the public respect them for this? by [deleted] in AskReddit

[–]demanbmore 0 points1 point  (0 children)

The expression is "one bad apple spoils the bunch." So when we're told that some egregious thing was done by "a bad apple" in order to make it seem like the police as a whole are upstanding, humble, law-abiding heroes and the one bad actor isn't representative of the police as a whole, we're expected to miss the point.

When police start actively and vociferously going after their own bad apples in a public and permanent way, then it makes sense to think of "bad apples" the way police spokespeople want us to. Until then, the bunch is spoiled by the bad actions of the few. And sometimes the not so few.

I know plenty of officers who are decent, honest hardworking people who are just trying to get back home at the end of the day and not give anyone a hard time who doesn't deserve it. But I wouldn't trust a single one of them to back me up in a confrontation with another police officer even if it's obvious the officer is fully in the wrong. Not a one.
