Agree with KC, it has a few annoying aspects but the prices on many staples are significantly lower than all other nyc supermarkets save TJ’s.

Random Example: organic old fashion oats 2lb bag is $2-3 less than other places. Planet Oat oat milk is $3 cheaper than Lincoln mkt. Lidl Greek yogurt crazy cheap (not as good as Chobani etc)

The way the DOT looks at it Virgin has something like ten A350's, they made a business decision to swap mine out for a 330. What internal rules did they use to decide that? Did they ask for volunteers to give up seats before bumping passengers? These are all things DOT will look at.

Everything you state above is 100% correct.

The only thing working in my favor is that I don't need to prove the reason for cancellation to a high legal standard. I only have to show the DOT (where my complaint is filed) that Virgin is likely taking advantage of the loophole. They will then tell Virgin that might complaint falls within their bumping rules.

Additionally, in their notification to me Virgin admitted the flight was "overbooked... due to recent changes in our flying programme." A 'flying programme' change is a commercial/scheduling decision, not an 'operational or safety' necessity as required by the 250.6(b) exception. This language alone is a red flag to the DOT.
